Deposit Dispute

Good morning AFCHO

Please note that i am sending this email om the behalf of Matsiliso (cc'd on the mail)

Matsiliso was staying in your building Atkinson House unit 557 for about 7 months, she moved out in December and according to you she will not receive hee deposit as she has not finished a year which is understandable as you claim its your policy.

Now the problem is why did AFCHO pay a friend which stayed not more than 5 months her full deposit and not pay Matsiliso who has stayed 7 months?

Please note that this is now a big problem as you pick and choose who to pay and who to not pay because that y is against the law and legal action is being taken, please see attached conversations with your previous client that you paid in full her name is Tebogo and she stayed at Unit 556 and she moved out in October and she is willing to testify that you guys starter by using the same excuse but ended up paying her amd she has sent us all the proofs.

Looking forward to your urgent response. Can you please also forward a copy of the contract that was signed by her.

 Dear Mbalenhle,  Thank you for bringing your query to our attention. We, at Afhco value your communication and take pride in attending to and resolving your query as speedily as possible    In view of a tenant request to cancel the agreement before the end of the Initial Period (12 months period of the lease) thus breaching or not complying with the terms and conditions of their lease agreement; we are entitled over and above any rights in law to charge you a reasonable penalty.    Tenant to refer to clause in their lease agreement.  If the tenant cancels the Lease agreement with the Landlord before the end of the initial period, the Tenant agrees that the Landlord will be entitled to charge the Tenant a reasonable penalty.  We are also within our rights to charge a reasonable percentage on the remaining period of the contract (which always works out higher than a deposit) but we do not as we comply and always want to be as even-handed as possible.

Why pay someone's deposit that stayed 5 months if that's your policy??? I am escalating the matter with the Ombudman,Estate Agency Affairs Board and the Renta housing tribunal,I will leave no stone unturned as we have proof and the person that you paid is willing to help and ive emailed the conversations with that person. Sort it out AFCHO and dont pick and choose who to pay.
