AFHCO Won't Refund My Deposit!

I’m disgusted about how Afhco treats their tenants and frankly, I read all the reviews here and most are about the same thing I’m here writing about.

I put a notice with building manager Lawrence during lockdown (3months before 30-day notice) that I can no longer reside at Northgate Heights unit number 216 and gave a written 30-day notice that I was to move and now it’s been over a month waiting for my deposit, no communication was made by Afcho to inform me. I called them several times about this issue and I keep getting disconnected by them on purpose, told different stories as to why I won’t get my deposit or sent me on a scavenger hunt to call Loraine who never seems to be available. I will not stop until I get my money back.

Dear Samantha Q,

Thank you for bringing your query to our attention.

After careful consideration and in view of your request to cancel the agreement before the end of the Initial Period (12 months) thus breaching or not complying with the terms and conditions of your lease agreement; we are entitled over and above any rights in law to charge you a reasonable penalty.  

Again, for ease of reference, see below clause from your lease agreement: 

"If the tenant cancels the Lease agreement with the Landlord before the end of the initial period, the Tenant agrees that the Landlord will be entitled to charge the Tenant a reasonable penalty."

As a reasonable penalty, we forfeit the entire deposit. We are also within our rights to charge a reasonable percentage on the remaining period of the contract (which always works out higher than a deposit) but we do not as we comply and always want to be as even-handed as possible.
