Afhco Frank & Hirsch with rats and withholding my Deposit!

I stayed in 506 Frank & Hirsch from 1 March, paid my deposit & rent in full & within a month there were rats in the apartment.

I wrote a request for maintenance & the rat issue was not attended to. I had to buy rat Poisson, mind you the anxiety of coming across rats while I am terrified of them & pregnant is not good for my health. I had to bath at a friend's place if I see a rat in the bathroom because I was strongly afraid of them. Constantly living on edge and waking up in the middle of the night to dust my bed because I thought I felt something move.

I finally put in 35 days notice in April to move out on May 31st. One week before month end of May they put in 4 boxes of pest control Poisson, no evaluation on whether this will not affect me or my unborn baby. The boxes trapped 2 rats and they indicated that they have no permanent solution to get rid of the rats yet. Which meant that I would have to live under those conditions God knows until when.

I have been now told that I will not be recieving my deposit because I left before the lease ended. My lease did not come with an agreement that says I will be constantly ****ing & living with rats & I definitely did not leave based on my own terms. I left because they could not pest control their rats and therefore I am entitled to my deposit!

Afhco is ripping people off! And then they expect us to reffer people or return to their buildings. I move mountains to get my money because when they demand theirs, they make no apologies but when it's time to cough it up there are stories. I was respectful enough to stay 1 month of torture and paid my full rent to ensure that I serve my notice and now they don't want to pay!

Dear Mandiphiwe

Thank you for your continued communication and patience,

After careful consideration and in view of your request to cancel the agreement before the end of the Initial Period (12 months period of the lease) thus breaching or not complying with the terms and conditions of your lease agreement; we are entitled over and above any rights in law to charge you a reasonable penalty.

For ease of reference, see below clause as per lease agreement clause 31.2

If the tenant cancels the Lease agreement with the Landlord before the end of the initial period, the Tenant agrees that the Landlord will be entitled to charge the Tenant a reasonable penalty.

We are also within our rights to charge a reasonable percentage on the remaining period of the contract (which always works out higher than a deposit) but we do not as we comply and always want to be as even-handed as possible.

Thank you for the response. So what would you have had me do? Should I have continued to reside in an apartment that constantly has rats when the manager has clearly indicated that there is no permanent solution for it? Should I have continued living with boxes of rat poisson until I gave birth? & continued to stay in that condition with a new born? I wrote to mantainance, I reported telephonically to Afhco and I wrote it on my 35 day notice? In that 35 days no one made an attempt to problem solve or have me moved to another apartment because that is the only reason stated for me leaving the building?! You did not once disclose that there is a rodent issue in the building to give me room to accept or decline the lease agreement. Had you indicated that I would have to reside with rats, I would have opted for a different building from the start! If there were no rats, I would not have risked ruining my furniture by moving. Whose fault is it that I had to move? So should I have completed 12 months of torture & discomfort for the sake of my deposit? Does the lease agreement give you the power to make residents live in filthy & uncomfortable conditions? I have been with Afhco since 2015, this is the Thanks one gets?

The (Building Manager) confirms that there was no complaint raised on the issue and no previous stage did he receive same from you.

I have a recording of my conversation with management where he confirms that he was aware of the rat issue and Mpho the maintenance guy raised the issued with him when he saw my slips & requests. Kindly refer me to an email where I can send it, alternatively I am happy to publish it?

I also have a call conversation that came from ********** on 22 May 2018 at 09h35 that has me indicating that I am vacating due to rat isssues, I was assured that it will be attended to & I would be given feedback. My notice from 24 April 2018, also indicates that I have rat issues on the reasons for leaving. Infact Mpho had to come to my apartment twice to take out dead rats & I have eye witnesses to that incident. Need I say more?
