Advtech Group wrongful submission of employee documentation to the Department of Labor

I have been employed by Advtech Group schools division from May 2019 - December 2019. Due to a legal matter between the school and an employee (teacher) I returned in January 2020 to assist the school in the position of that teacher up until legal matter was resolved between the two parties.

I worked till end January (as the before mentioned teacher returned on 3 February when the legal matter was resolved). Since mid February I have been calling, messaging and e-mailing Advtech HR to submit appropriate UIF documentation to the Department of Labor for me to be able to claim UIF. Both the school where I was employed principal as well as HR from Advtech refused to share information and contact detail from their finance division to sort out paperwork for UIF and payment of salary for work completed in January. End February I received payment for January but still paperwork was not submitted for UIF. On various occasions I contacted Advtech to explain my livelihood is greatly impacted due to their non submission of paperwork. They assured me that paperwork will be sent by the 7th of that month. 13 March I submitted my claim for UIF which takes 35 days to process. On 4 April UIF rejected my claim as Advtech submitted paperwork incorrectly to the Department of Labor stating that I worked 0 hours during January and therefore they made R 0 contribution to the department for the January period. They incorrectly submitted that I was employed in February and made appropriate contributions for February (when I was not employed or did not work for Advtech). Because of the wrong submission and payment break of UIF contributions because Advtech stated I did not work in January I can now not claim UIF.

I sent Advtech HR screenshots of their submission as reflected by UIF in accordance to their submission. Their HR then send me their UI 19 and employment certificate stating I worked there in January and February. After I once again explained that I only was employed in January and they need to correct paperwork. Advtech ignored me. When I stated that I will make use of public platforms as one mean to get their correspondence to correct their error in submission they sent me a company letter stating that I was only employed in January. I asked that the UI 19 would be corrected as well so I can submit to DOL and then once again claim. Advtech once again is not responding to any mails or calls. They operate via a switch board and promise that the HR will contact me but they do not.

Since end January Advtech has not corresponded appropriately and submitted false documentation to the Department of Labor which they are not willing to correct. Due to their false document submission I have been without Income for February, March and April that I lawfully and rightfully can claim from UIF as I have been diligently paying UIF via Advtech. All I have been asking for is a UI 19 form that reflects January hours worked and the UIF contribution made that month. Advtech Group is not willing to provide this legally required paperwork for DOL to achieve re-submission to claim UIF and receive UIF.
