False Misleading Advertising, Rejected Claims Despite Electrical Components being covered!

Rejected Claims Despite Electrical Components Being Covered

AA Warranties clearly states on their website and marketing platforms, "OUR AA WARRANTY POLICY HELPS YOU WITH THE COST OF PAYING FOR MECHANICAL, ELECTRICAL AND ELECTRONIC FAILURES THAT MAY HAPPEN TO YOUR VEHICLE"

I purchased the AA Warranties Evolve Turbo Plan (Policy No. 344025) on the understanding that both mechanical and electrical components are covered.

However, two of my recent claims were rejected:

Claim No. 34163 – Faulty Steering Column Control Module (SCCM)

Claim No. 40324 – Electrical failure of the safety parking/camera system

The rejection reason provided was that “electrical faults are not covered,” despite the policy wording clearly listing “Electrical Components” as covered items.

I find this to be misleading and contrary to the advertised benefits of the policy. The SCCM and parking/camera system are safety-critical electrical components, and their rejection raises serious concerns under the Consumer Protection Act.

I have lodged a formal appeal with AA Warranties and requested a proper explanation, failing which I will escalate the matter to the Motor Industry Ombudsman of South Africa (MIOSA).

I am sharing this experience so that other consumers are aware of potential misrepresentation in cover and to urge AA Warranties to deal with this matter transparently and in good faith.

Reviewer Update
I am extremely disappointed with the handling of my warranty claims under my AA Warranties Evolve Turbo Plan, Policy No. 344025.

Both of my claims were rejected:
  • Claim No. 34163 – Faulty Steering Column Control Module (SCCM)
  • Claim No. 40324 – Electrical failure of Safety Parking/Camera System

The stated reason was that these “fall outside the scope of cover” and that “electrical faults are not covered.” This is factually incorrect and misleading.

1. Policy Contradiction
  • The Limits of Indemnity Table clearly lists Electrical Components, GPS, DVD, Phone/Internet System as covered.
  • The policy defines a covered event as “the sudden and unforeseen breaking or shorting-out of any covered mechanical or electrical components.”
  • The blanket statement that “electrical faults are not covered” is a direct contradiction of the contract terms and amounts to misrepresentation of benefits.

2. Steering Column Control Module (SCCM)
  • The SCCM is an electronic safety-critical control module integrated into the steering system.
  • Although “steering column” is excluded, the SCCM is an electrical component, and the failure directly affects the safe operation of the vehicle.
  • Under the Consumer Protection Act (CPA), Section 48, any exclusion that compromises public safety is unfair and unreasonable.

3. Parking/Camera System Failure
  • The Mercedes-Benz MBUX system includes GPS, DVD, phone/internet, and the 360° safety parking camera.
  • These are all expressly listed in the policy under Electrical Components.
  • Rejecting such a claim while marketing the plan as covering “mechanical and electrical failures” is a clear breach of consumer rights.

4. Consumer Protection Act Rights
  • Section 48 CPA: Protects against unfair, unreasonable, or unjust contract terms.
  • Section 55 CPA: Guarantees consumers the right to safe, good quality, fit-for-purpose goods and services.

My Demand I request within 7 business days:
  1. A full reconsideration of both claims.
  2. A written explanation citing the exact contractual provisions re**** upon in the rejection.
  3. Confirmation that “Electrical Components” are indeed covered, as marketed.
  4. Reimbur*****t of repair costs, as per insured cover.

If unresolved, I will escalate to the Motor Industry Ombudsman of South Africa (MIOSA) and the National Consumer Commission (NCC) for further investigation.

This matter should not have to reach an Ombudsman — I expect AA Warranties to honour its commitments and treat consumers fairly.
