Car insurace pay out

On the 20/11/2017. I was reversing out of a car parking & looking first in the direction where cars were CORRECTLY coming from, & before I had a chance to look in the other direction, a car drove into me – it was driving up the one-way road in the incorrect direction. Obviously as the accident was caused by the other driver, I got the two quotes that were requested by the driver’s employers insurance company. I was shocked to receive an offer from their brokers Bryte Insurance Company which stated “Please be advised that we have considered the merits of the claim and the decision is to settle the claim at 50/50 apportionment. The basis of the decision is that a reversing party is supposed to be more vigilant. Even though you were reversing into a one way road, you were supposed to keep an eye on both directions. Our insured was also at fault for driving in the wrong direction of a one way road.

We have arranged a desktop assessment of your claim but as discussed above, we will offer 50% of the assessed amount.” I called Bryte & their very rude Third Party Negotiator told me I was welcome to report them to the Insurance Ombudsman, but that wouldn’t help as the accident was my fault as well. Yesterday 23/1 I received another email which stated “Please be advised that we have discussed the matter and the decision stands. We will not amend our offer of 50%. As the reversing party, you were supposed to be more vigilant and keep a proper look-out. The 50% offer is more than fair as the matter could easily have been rejected.” I am absolutely disgusted, especially with the final comment! How could this matter have been “easily… rejected”? I am unsure if that was a warning to me that should I not accept their offer, they might withdraw it!!
