BRYTE 3RD party claims sucks, if you are insured with Bryte, this is how they'll probably treat your 3rd party, nobody wants to be treated like this

I was stationary at a red traffic light when someone drove into the back of my car. He admitted it was his fault, took pictures, exchanged information and off we went. So its his fault and this is what his insurance (Bryte insurance) had to say:

We hereby confirm that we have validated the claim and all supporting documents submitted herein.

According to the information at our disposal, it is recorded that our insured was stationary behind your vehicle. There was a guy who tried to grab the insured’s phone and in trying to avoid the *****, the insured drove into the rear of your vehicle.

It is evident that the insured was placed in a situation of imminent danger and could not have reacted in the agony of that moment with the same degree of judgement and skill as could be expected of him in normal circumstances when he has time to weigh the pros and cons of the situation.

We refer you to (R v Phillips 1949 (2) SA 671 (0) where is was held that a driver (it is self-evident) who is suddenly confronted with an unexpected danger may, and probably will, act differently from a driver who does not have to act without much time to make a decision, and on the spur of the moment he may do something which causes the very collision he is anxious to avoid.

In light of the above, we are refuting liability and confirm that should there be any legal action taken against the insured, we will defend the matter vigorously.
