3rd party claim

<p>on the 11th of December 2016 I was invloved in an accident with a vehicle insured by Zurich. The bus was involved in another accident with another vehicle on a single, one way lane and occupied most of the right hand side of the road. It was a one way single lane there was no alternative to make a u-turn due to the traffic because it was after a national event at the standard bank arena.</p> <p>Like most cars before me we opted to pass the bus on the left hand side as it had sufficient space and was the safiest way to drive pass the accident. Unfortunately for me the bus opened the bus door as we were driving pass the bus and badly damaged my car.</p> <p> </p> <p>I spoke to the bus driver and he adnitted to the fault and gave me his office number, I called the office and they gave me their insurance details. I logged the claim with Zurich in December and was requested to provide quotations. It was during the christmas period and most companies were closed so I provided the quotation in the first week of January. After numberous calls in following up with the claim it was eventually handed over to the third party department. I was again requested to provide a quotation which I did though I felt was redudence of information as if I was dealing with different companies.</p> <p> </p> <p>After couple of weeks of trying to get to the closure they sent through an assessor to asses the vehicle. A week after the assessor has assessed the vehicle I kept calling on a daily basis to get my car fixed. eventually last Friday(10th March 2017) they sent me an email to reject my claim, claiming that it was ******* of me to overtake on the left hand side of a vehicle. I explained to them that according to South African law, you refer to overtaking to 2 vehicles in motion, if one vehicle is stationary then that is no longer reffered to as overtaing however it is driving pass a stationary vehicle and because the stationary vehicle was obstracting my right of way I had no other option but to pass on the left. Furthermore Reg 298 of South African law permits one to pass a stationary vehicle on the left if it is safe to do so. Till this point no one has rep**** to my email and Vusi Ngwenya has been ignoring my calls.</p> <p> </p> <p>If this matter is not resolved by Friday the 17th of March 2017, I will be escalating this matter to the short term ombudsman. This service is parthetic even worse in quoting **** laws.</p>
