Refusal of deposit refund
On 5 February we entered into a contract to buy a 2nd hand Bakkie from Mr J P Jordaan from Extreme Access & Security. He insisted that we pay him a holding deposit of R10,000.00 & agreed to keep the Bakkie for us until we have the balance in a weeks time. He gave us a copy of the wrong document, which showed the owner as another CC. When we went to his house to pay the balance we noticed that the Registration docs were still not in order. He wanted to give us the same docs but a colour copy of it. He gave us all kinds of excuses and promised to sort out the docs. We then told him that we will only pay the balance once the docs have been sorted out. After that we didn't hear from him and we phoned him and sent him emails to cancel the deal. He refused to refund us our deposit & we instituted a small claims case against him & won the case. A letter of demand & Warrant of Execution was issued against him & up until today he is ducking the Sherriff's Deputy, as we now have a Warrant to attach movable goods to the value of R10,000.00
