WONGA FINANCIAL SERVICES SA TERROR!!!

!!! RIDICULOUS SERVICE !!! NOT ADVISABLE TO WORK WITH !!!

On July 10th, I app**** for a loan with these guys. They approved it and sent me the agreement via email. A 3/4 days later I decided rather not to take the loan anymore. I called their call center, which said I must use live chat or email their customer care. No response has been received from them till today.

As per law and what is clearly stated on their agreement (I quote); "8. Right to cancel in terms of the ECT 8.1. This is an electronic transaction and as such, the provisions of this Agreement are governed by the provisions of the ECT. 8.2. In terms of section 44 of the ECT, You are entitled to cancel this Agreement without cost or penalty on the later of the 7th (seventh) day following: 8.2.1. the date on which the Loan Agreement is accepted by You or 8.2.2. the date on which the Loan Amount is transferred into Your account, whichever is the later 8.3. If You cancel this Agreement in terms of clause 8.2 above, You will repay Us the Loan Amount. 8.4. In order to repay Us the Loan Amount, You hereby authorise Us to immediately initiate a one-time debit to the bank account You have specified in the Debit Order Authorisation in the amount of the Loan Amount advanced to You." (Unquote)

Now in terms of section 44 of the ECT, I submitted my cancellation request daily via email. NO ONE has ever responded. I will be taking this further should they debit my account with their loan premiums as I sent instructions that I want to cancel well in advance and within the prescribed time.

What a nightmare!!! Wonga only responds when we complain about them on social media platforms.

These guys sent me an email saying if I want the cancelation I must pay back their money, I did that on the same day and sent the proof of payment to their contact center and collections email addresses. It's now day 5. No response and they'll be telling me about how their call centers are overwhelmed and all that diplomatic hogwash.

To top the nonsense off, I've just received an SMS saying they'll be debiting my account for the loan installment, that time I piad these guys back.

Clearly this needs attention from the national credit regulator and the consumer goods and services ombudsman as what they are doing is not in line with the Consumer Protection Act including the Electronic Communications and Transactions Act no 25 of 2002.

I communicated with these timeously that I want a cancelation. They did not respond. Claiming they are overwhelmed now they want to debit my account when I have paid them back their principal loan amount and sent proof of payment days ago.

I will not be reversing unauthorized debit orders and I will not be liable for the bank charges.

Further steps will be taken should any of this occur.

I have received your letter. It says "Paid Up Letter". And note that all bureaus have been updated.

For clarity and record, have they been updated that the loan agreement was not accepted and therefore the account was subsequently not opened or have they been updated that I have "paid up" my loan account?

As these are 2 different things, it is important to share accurate information with the bureaus.
