THE WONGA TEAM:: A SHAM APPROACH TO CREDIT AGREEMENTS/LOANS
1. During the month of February 2018, I received a deposit of R 4000 in my bank account. Subsequent to receiving the Deposit, I received a call from a WONGA representative, whereby the it was stated by the WONGA representative that they have mistakenly deposited money into my bank account and that I must pay (deposit) it back to them. In response I demanded that the request or the telephone communication be conveyed by email and further requested that WONGA enlighten me as to how they were able to get my banking details and cell phone number. In this regard the following email communication was exchanged, : "wonga team Inbox x wonga wonga ********** Feb 13 to me

(i then responded as follows):
xola vabaza ********** Feb 14 to wonga Good Morning I hereby acknowledge receipt of your email and as per the telephone conversation I will abide. I actually gave the deadline of Friday and explained as to why. Kindly note that I also requested that Wonga relay to me how it got hold of my details (telephone number, and the bank account etc). was this given to you by the bank ? or is there an authoritative agreement that empowers Wonga to have information relating to my bank details (phone number, bank account, etc).
kind regards". 2. Needless to say that no response was given by WONGA as to how they obtained my personal banking information and I must also admit that I therefore did not return the money. 3. Deducting from the above mentioned chain of events, it is clear and irrefutable that I have never entered or reached and credit agreement with WONGA whether it is a loan or otherwise. 4. However, and more worryingly, I have recently asked for my consumer credit report and to my surprise I found a credit account with interest by WONGA listed against my name. Thus, the inference drawn is that I have entered into a credit agreement with WONGA. 5. Again it should be highlighted that I (the actual legal person) has never in any shape or form entered into any credit agreement/loan with WONGA. Thus, it is legally misleading and incorrect for WONGA to list me as one of its debtors under a false claim of a credit agreement. 6. The incident of a mistaken deposit by WONGA into my bank account does not translate into a loan or any credit agreement, thus does not meet the lawful definitional elements of a credit agreement. 7. Can WONGA explain; what authoritative or lawful grounds allows them to list me as their debtor (someone/borrower who entered into a lawful credit agreement with the lender) and also how does money mistakenly deposited into one’s bank account generate interest and be registered as a loan?

IN ADDITION, YOU HAVE LISTED ME AS YOUR DEBTOR ON THE CREDIT BUREAU DATABASE INFERRING THAT I ENTERED INTO A CREDIT/LOAN AGREEMENT WITH WONGA.
PLEASE NOTE THAT A CREDIT AGREEMENT IS DEFINED IN TERMS OR THE NATIONAL CREDIT ACT. PLEASE PROVIDE ME WITH THE CREDIT AGREEMENT AS PER THE NATIONAL CREDIT ACT DEFINITIONAL ELEMENTS.
PROVIDE ME THE MANDATE WHICH EMPOWERS WONGA TO LIST ME AS ITS DEBTOR ON THE CREDIT BUREA DATABASE.
I WILL TAKE YOUR COMPANY TO THE NATIONAL CREDIT REGULATOR FOR ITS ******** AND ********** CONDUCT.
YOU CANNOT LIST ME AS A DEBTOR WHEN A CREDIT AGREEMENT DOES NOT EXIST (THAT IS JUST SIMPLY THE LAW).
I HAVE ADVISED YOU SO CALLED DEBT COLLECTROS AND THEY CAN'T EVEN PROVIDE A RESPONSE.
EVEN YOUR ***** UNIT, NEVER RESPONDED TO THE QUESTIONS I POSED TO IT.
