Defect on goods purchased

Hellow Peter I would like to share a story and hopefully get assistance . My mother bought this lounge suit in April 2017 from Winston Sahd East London for R50 000. Around June/July 2017 they started showing some defects and we advised the sales lady when she gave us a courtesy call but she did not take note of that. The problem went on and we kept on telling this lady and she did nothing about it.

In December of the same year my mom physically went to the store but was chased out being told that it was too late for her to report the matter as it was 8 months since she bought them. We were sent from pillar to post being blamed for the defects and we advised them that we have never used any product on them and that we do not even have kids who could have caused damaged to the goods.

I decided to write an email to the owner and she responded via her lawyer that there was nothing they could to to help us. Instead they sent people from their factory to bring cushion but they returned with them as they could also see that we needed replacement of the goods, but our plight was in vain. I also write to the consumer protection and got no assistance.

I would like to check is there someone who can advise on what we can do to get my moms value for money, R50 000 is a lot of money for a pensioner who wanted to retire comfortably but instead got a raw deal. All we need is a replacement not even the money. They are even worse now it’s embarrassing.

We would appreciate anyone who would be willing to assist please. Can this matter be escalated to the court of law if possible?
