Forfeiting of Deposit?!
My husband and I app**** for a property to rent, we filled out the attached application form and paid a damage/key deposit and the first months rent was payable upon receiving the keys. We found out we were being retrenched soon after and I wanted to be straight up and honest with the agent. I called Linda in February and I told her to hold with everything and to find new tenants as we would not be able to afford the place due to the fact that we were anticipating retrenchment. We also thought it would be unfair to move in knowing we might not be able to pay. We have since been retrenched.<br> <br> I called Wakefields on 01/03/2016 to find out when we could get our deposit back and were told by Linda Mitchelle that the deposit had been forfeited as per the form they had me sign. However they never filled that part into the form. We are more than willing to pay an admin fee for the processing of the paperwork that they did, however we NEVER even received the keys for the premises. I feel this is absolutely unfair and *********.
You entered into an agreement of lease for one year to occupy a Pinetown property effective from 1 March 2016 to 28 February 2017. You paid an amount of R 9800.00 on the 4 February 2016 to secure such lease, with the balance to be paid before you took occupation.
You called the broker on 18 February 2016 informing her that both you and your husband have been retrenched and that you will not be able to take the premises. Whilst this is extremely unfortunate, you will appreciate that you have committed by signing the lease for one year, therefore are liable for the rental for the duration, unless an alternative tenant is sourced to take over from your lease.
Whilst every endeavour is being made by Linda to find a new tenant, regrettably she has not been able to do so as yet. The R 9800.00 deposit held is being utilized as rental for the month of March 2016, which the landlord is entitled to.
It is worth noting that the landlord has had to incur a further cost to hire a security guard for the month of March due to the fact that the premises is vacant.
