Volvo SA - Sales/Trade-in dishonest dealings
Reference Number ***9: I recently bought a vehicle, Volvo V40, from a Supergroup Dealership - Auto Baltic Eastrand. About 2 weeks after the sale agreement was concluded I was contacted by the dealership to tell me that the deal had been structured around the incorrect trade-in reg year. The difference in trade value amounts to R40 000. Dealership wants me to add this amount to my financing agreement or they could just cancel the deal, uplift the V40 and return my trade-in. Why am i being held responsible for their mistake? This should have been picked up when they requested the settlement value on my trade-in, or the NaTIS document, by both the sales people and also by the person arranging the financing. They've failed to settle my trade-in which means that I now have 2 vehicle's debt that I am responsible for and if I default on either it will affect my credit rating. I have also revisited the financing agreement and see that the V40 reg number captured by the financing person at the dealership is also incorrect. Will I be held responsible for this as well?? I have also logged a call with Volvo SA but have received no resolution. They've only handed the issue over to the dealership. I was escalating a matter and they were de escalating it.

We take note of the correspondence between yourself and David at Auto Baltic East Rand regarding the most recent sales transaction. We also take note of the Hello Peter comment and your call to Volvo on Call which reached their call center.
VCSA as the wholesaler of Volvo's into the South African market is unfortunately due to the Competition Law of South Africa not allowed to get involved with the direct sales transaction between yourself and the Franchise dealership - Auto Baltic East Rand. The contractual obligations is between these entities and not VCSA.
At VCSA we will always try and mediate the situation however this can only be done within our scope of control. We have been made aware that the dealership has provided you with options to proceed with the current transaction, which will result in a financial contribution from you to assist with the shortfall on the retail value of the correct year model of the trade in. The second option is to cancel and uplift the entire transaction and returning your vehicle as well as refund on your deposit to you. As the customer you will therefore have to make the decision on how to proceed.
We suggest that should you still feel aggrieved that you approach the Motor Industry Ombudsman (MIO), in order to have the matter independently reviewed. As a matter of principle, Volvo Cars support and seek to uphold the aims and objectives of the MIO and as such will abide by and honor any decision taken by the Ombudsman in this matter as a result of any review they may undertake.

I have to say that this is a very disappointing outcome given that the Volvo image is also at stake. Needless to say i have spoken to a few people regarding this situation and all they will remember is that it related to a VOLVO car., not who the dealership was.You don't mention the third option of the dealership taking responsibility for THEIR mistake instead of trying to hold me accountable. Instead by mentioning the 2 options only, it would seem that you are endorsing their behaviour. I was carefully taken through all the contractually required documentation and at no point was mention made that the dealership had the option of doing what they are doing due to their negligence.
