UNAUTHORISED DEBIT ORDERS!
<p>I trained with Viva Gym in Montana for a month in January this year. When I joined them the agreement was that I will train at this gym from month to month and pay them cash. I specifically said to the consultant that "No thank you, I dont want a debit order" Well 8 months later I realised that they cleaned out my savings account! I finally realised this because I got an sms of a debit order reversal of R269.00 This means they took R1614 from me and this was never authorised! Is this legal??</p>

We are sorry if there was any misunderstanding. We have sent you an email of your signed Agreement and Terms and Conditions. You will see in our Terms and Conditions that debit orders are presented to your bank for payment until you cancel your month to month membership which can be done easily online, in your member area, or in the gym. You continued to visit the gym until April and we have always received our monthly fees from you by debit order. We have searched our database to find a request from you to cancel, but can’t find one. If you have an acknowledgement of a request to cancel, please let us have a copy of it and we can review the situation.
To avoid debit orders going through when you are an active member, payment may be made by EFT or in club before the first day of the month for which you are paying. Our records show that all of your payments after you joined were made by debit order.
As mentioned in our email to you, we have cancelled your membership with immediate effect and no further debit orders will be presented to your bank account for payment.
