Total Incompetence: Contractual Failures, Data Breaches, and Unauthorised Debits

My attempt to join Virgin Active Stellenbosch with my family in September 2025 has been a case study customer abuse. I am posting this as a warning to all potential members.

Here are the undisputed facts of my experience:

Gross Contractual Error: After signing up, our memberships failed to activate for over two weeks. We eventually discovered that Virgin Active's staff had signed my son up to the wrong club (Alice Lane in Johannesburg), on a completely incorrect package, rendering the contract void from the start.

Breach of Advertised Promotion: We joined under the "Hello September" 20% discount promotion. This is even noted on our contracts. Virgin Active failed to apply this discount and has ignored all requests to honour it.

Bait-and-Switch: A key part of our agreement was a free Premier membership for my son. In their attempt to "fix" their original error, they tried to switch this to a paid, lower-tier Club membership, classic bait-and-switch which is ********.

POPIA Breach: Management requested sensitive passport copies via insecure email and then refused to confirm their deletion, claiming a "business requirement" that is not supported by the contract or POPIA, thus violating my data protection rights.

Unauthorised Debit: While my complaint was actively with their Head Office escalations team, Virgin Active proceeded to take an unauthorised and incorrect debit from my bank account, which I had to reverse through my bank.

This was not a simple mistake. It was a complete breakdown of their administrative processes, a failure to honour their own promotions, a breach of the Consumer Protection Act (CPA), a violation of the Protection of Personal Information Act (POPIA), and ultimately, an act of bad faith by taking money ********ly.

Their final "resolution" was to ignore the core issues and continue to misrepresent our original agreement. I have now escalated this to the CGSO and the Information Regulator.

Prospective members, be warned: Scrutinise every line of your contract, get every promise in writing, and be prepared for a fight if they get it wrong.
