Cancelling my contact due to immigration

I called your call center in the 31/05/2024 advising them of my intention to terminate the membership. I stated the reason for the termination is due to emigrating to Netherlands and I have already done my research and there is no VA there.

Now my issue is the fact that I understand that there is a cancelation fee however I know very very well that there are instances where this is waived and my emigration is one of them.

I am even willing to send a copy of my contract at the new employment to show that I am actually moving.

I am now asking myself how do I then continue to pay for this “luxury” when I am not here?

Let’s make an example, the cancellation fee is about R4000. Now let’s say VA is liquidated and seizes to exit or it’s bought out. Would the board of directors pay each and every VA member the R4000 since the contract would be cancelled? I am 100% sure they will not.

Now since the call centre is referring to the contract, let us define the characteristics of a contract:

They are: 1. Legality 2. ⁠Capacity 3. ⁠Offer 4. ⁠Consideration 5. ⁠Intention 6. ⁠Cer*****y 7. ⁠Acceptance

Now my dear Sirs and Madams when ONE JUST ONE of these are not met a contract by law is deemed null and void.

Let’s us look at number Capacity and Intention.

I am saying to you I have all the intentions to come and utilize your facilities however I incapable to do so.

What is causing this incapacity? It is CHANGE OF ADDRESS!!

By providing you with my new address my contract is deemed ******** and I am not due to pay anything due to this cancellation.

Do you understand what makes a contract?

By all means if can find a gym in Netherlands point me to it and I’ll use it.
