Consumer Protection Act Ignored
On 29 June 2017 my elderly mother bought a Genesis Cordless Sweeper from Verimark’s Bedfordview store. Although it was rarely used, it stopped working shortly before Christmas, so we returned it to the store where we were told it must be sent for repair. It was only later that we found out that the Consumer Protection Act (CPA) says the store must offer a CHOICE of repair, replacement or refund. As this is a discontinued product we would certainly had asked for a refund. After a long wait we got it back in mid-January. Once more it was used infrequently. Several weeks ago it stopped working again, so we returned to the store late one afternoon, not realising that the Customer Care office had closed for the day. We made it clear that we did not want Verimark to repair a machine that keeps breaking. The salesman refused to let us leave the machine there unless we signed it in for repair, but he promised to contact Customer Care the next day and then phone us. We do not live near to the Bedfordview store, but when we had not heard from him several days later, we had no choice but to take the machine in again. This time the staff put us through to someone at Customer Care who insisted that the machine must be sent for inspection before the matter could be discussed further. The machine was then sent for inspection, accompanied by a note saying we were unhappy and wanted a refund. According to the CPA, if a faulty product stops working again within 3 months after being repaired, the supplier MUST replace it or give a refund. A second repair is not acceptable. We were told that we would be contacted once it had been inspected. Once we’d left the machine, we waited for the call we’d been promised, but never received it. Instead, several weeks later (on 10 May) we received a call to say that our machine had been repaired and was waiting to be collected. What must we do when Verimark does not adhere to the CPA?
