MISSION IMPOSIBLE!!!!!!!
I bought a bakkie (Frod Ranger, 2.2 XLS 2016) at Velocity Cars in Capetown. I was browsing the Auto trader for an upgrade in my bakkie and saw this Ford Ranger. I live in JHB and the bakkie was in CPT so it makes it a bit difficult to physically go and see the bakkie. I called Niyaaz from Velocity Cars and started discussing more info about the bakkie. I got promised that this bakkie is in mint condition, that nothing is wrong with it and he service plans, services, warranties, all extras fitted correctly and everything will be still in place. All sounded like a good buy but I had to think about it. Niyaaz started calling me to tell me he needs an answer because he wants to put the sale through for February 2017. After a few days of constant pressure from Niyaaz to buy the bakkie I decided to go with the deal. I asked him the process of going forward with the deal; he said he would drive the bakkie down to JHB after all documentation is signed and ready. I signed the documents on 27 Feb at Daddas Motor land in Fourways. I received the bakkie just after 5pm that same night. He did not deliver the bakkie himself but had someone to drop it off. As all people are excited to receive a new car / bakkie we check through most of the interior and exterior. I saw the licence disc was expiring the 28 Feb 2017. Normally with all new registration it will be extended and new number plates will be given. (Till today 08 Nov 2017 (and till ongoing) I still don't have my registration papers nor new number plates). I presume I can open a case of theft against him. I paid the registration fee and got no service for that money!! I saw the tyres was low on tread so I called Niyaaz and asked him what can we do about this matter as the tyres is 22" and it is very expensive. He promised me he will replace the tyres. After a few calls and mails back and forth I still don't have it. He then asked me to get quotations and he will pay it. So I got quotations from TWT, sent it through and still no satisfaction. I asked him about my spare key and he said he will give it to me, till today I still don't have my spare key. The next morning I had to go to work so I stared the bakkie and saw there was no lights. The only lights working on the bakkie was 2 LED fog lights and bright's. (I leave home anything from 5am so it is dark outside. Also I work on a mine outside of Westonaria so it’s about 60km of dark roads and passing townships). I called Niyaaz and said the bakkie does not have lights. To me it was a big risk traveling on the roads with no lights. (Also, how did he drive the bakkie down from CPT to JHB with no lights). After a huge struggle to try sort out the lights and almost having 2 accidents on the roads due to not having lights, (dogs and jaywalkers over the highways close to Soweto townships) i still did not get any feedback nor solutions. My bakkie was due for a service so I took it to Ford Action Constantia. I asked them to look at the lights and got confirmation the headlamps was missing. So I called Niyaaz again to tell him I need the lights and he needs to send me someone to come and sort it out or I will install them at Ford and he will be responsible for the account. Niyaaz then told me to get Ford to put it in and then he will refund me back the money. So I ask Ford to replace the lights but they then refused to install the lights and explained to me when any unauthorised alteration's is made to the bakkie my warranties expires because of the non-factory fitted equipment, wiring and installations done. After a few calls and mails again complaining about the service I'm getting from Velocity Cars and all the promises that was made that was not kept Niyaaz asked one of the Auto Electricians to come out and fix the lights. I think it’s was K&E auto electrician based in Benonni. (They do all the pre-inspections for Daddas Motor land before it goes out, to make sure all is in order). They came out to the mine where I work to fix the lights and replaced all lights with low quality lights. Over the time I'm driving the bakkie you start noticing things. The bakkie has a flat spot from 2nd to 3de gear. You can feel it (loses power) and sometimes it’s fine. K&E auto electrician added a bottle of injector cleaner in but still happening.
Niyaaz offered me R210 000 for my bakkie I still had +- R186 000 outstanding on my previous bakkie. I asked Niyaaz how he will pay out the money. He said he will pay it out as soon as he settles the bakkie. The bakkie was requested to settle on 21 Feb, taking in note settlement is to be paid within 7days, I only got paid out my +- R23 000 on the 20th March 2017.
So here is my list of complaints: 1) No lights; 2) Registration and number plates; (GETTING FINES and getting pulled over in roadblocks letting me go with warnings that they going to impound my car due to I don’t have the correct number plates nor a valid license disk) 3) To replace the tyres that was promised; 4) Spare key; 5) No DAKRA inspection was done before sending the bakkie to JHB or before it came to me; 6) Warranty expired due to alterations done and cannot provide me with RMI approved certifications; 7) The bakkie has a "flat spot" in gear 2 and 3; 8) Paying out of money for trade in. 9) Due to the 22” mags it has on, the gearbox in not holding it cause the gearbox was not adjusted to take bigger rims.
On top of all of this, I decided to take my case further to MIOSA (Motor Industry Ombudsman of South Africa). I filled in forms sent through all relevant details. After 6 months of no communications to where I stand, how far the case is or even updating any progress feedback I get a mail telling me, unfortunately they cannot assist me and referred me to the NCC (National Consumer Committee). Therefore, I start the whole process again of forms and waiting. The claims letter states that it can take up to 60 working days to be finalised, I am standing on almost 90 days with no feedback what so ever. I have sent mails, I have 7 numbers that I call on a daily basis but no one picks up the phones. I cannot do anything ells due to I still have an obligation claim with The NCC. I cannot get a lawyer, nor do anything ells until they come back to me, otherwise my claim gets “kicked out”
I really hope someone is reading this and is willing to assist me with this or even just give advice going forward. Cause im at the end of the ropes but won’t let go!!!!
Kind regards
