What is it called when someone takes your money but does not deliver the merchandise ...

I wrote a review previously complaining about a fridge which was paid for but never delivered and a refund which was promised but never executed.

The merchant responded (but again did not comply with their undertaking) and I am really amazed that after months of inactivity the merchant complains about my follow-up review (which is then deleted).

Needless to say, the email that was claimed to have been sent - has not been received. However I am used to promises of emails that simply do not arrive (and I check filters regularly).

To add to the litany of complaints here: payment made and no delivery of the merchanise. I can't say what that is legally without being accussed of breaching the terms, so I leave the reader to draw their own conclusion. Refund promised, but never executed. Again - draw your own conslusion.
