Unauthorised Contract - Pensioner Abuse!

<p>I write this article on behalf of my parents in law who are both pensioners and who called me in tears last night as they don't know which way to turn.</p> <p>Trudon account number ********** 381 - Krugersdorp Kennels.</p> <p>Krugersdorp Kennels received an account from Telkom on the 4th April 2012 for full and final settlement and confirming that the account was closed. Sometime during the course of 2012, Mrs Brennan received a call from Trudon wanting to confirm her address, not knowing what it was about and unable to communicate properly with the consultant that contacted her, she ended up giving the consultant the "old street name" which was the first and last contact made by Trudon. This also happens to be the address on the “Yellow Pages”.</p> <p>The next contact they ever got was from Dadic Attorneys in 2016 to state that their account was just over R 15 000.00 in arrears and they have been handed over. Being pensioners and receiving a phone call and correspondence from an attorney, they were terrified and agreed to a payment arrangement of which they had no idea what it was about. They started paying R 1000.00 pm in June 2016 and made what they thought was the final payment of R 3234.00 on the 26th May 2017. When they requested confirmation from the attorney that the account was paid up, to their horror, they received a statement to show they with interest and legal costs, they still owe R 15 550.00 which is actually more than what they started with.</p> <p>This is complete and utter abuse, firstly, there is no contract between Mr Brennan T/A Krugersdorp Kennels and Trudon, even if Trudon claim to have spoken to Mrs Brennan to update her address, she is not the company being charged and would not be able to agree to a contract without Mr Brennans consent. Secondly a “telephonic contract” needs to explained in detail and the terms and conditions read out to the client and only then are they given the option to accept or not. Not only is this abuse on an easy victim, but this is completely against the rights of any individual in the consumer protection act. These pensioners need every penny they can get and between you and your debt recovery attorneys, you are robbing these and many other people out of their hard earned money.</p> <p>I have sought legal advice and if Krugersdorp Kennels or Mr and Mrs Brennan have not been refunded by Trudon or Dadic Attorneys for the full amount of money they have contributed over the past year, we will be taking this to court and we will be suing you both for a lot more than just the funds, they have been threatened with attaching their property and the stress on this elderly couple that will be seen in court, will have you digging deep into your pockets and this is no threat, this I can guarantee.</p> <p>I expect an urgent response soon.</p> <p>Regards</p> <p>Trevor</p>
