UNACCEPTABLE! PAY WHAT IS DUE
I WAS ASKED TO TRANSPORT FAIRIVIEW GOLF ESTATE GOLF COURSE WORKERS:
I have a whatsapp agreement in place from the previous Chairman (Sean Heroldt) of Fairview Golf Estate whereby he agreed to me transporting the Golf Club workers for an amount of R3000.00 per month. Starting on the 1st of June 2022. A new board of trustee's and Chairman were appointed (Namely Brian Davids) The vehicle that was agreed upon for me to use to transport was taken away. The Golf Club was closed and the workers were not working. I sent my invoice through to Tesna at Trafalgar on the 23 June and am still waiting on a reply.. Today being the 5 August. I received a Whatsapp from Mr Brian Davids on the 30th of June 2022 saying that payment would be done tomorrow being the 1st of July. I AM STILL WAITING! I have followed up numerous times and still payment has not been done. I then received an email from Brian on the 4th of August 2022 saying that Trafalgar are not prepared to pay me as there is no contract between myself and the HOA. How can this be accepted when I have sent proof of the agreement on whatsapp many times by the previous Chairman. I then received an email this morning being the 5th August 2022 saying..
Sidney, What I did mention is the fact that you cannot get paid for the entire month should payment be done! Which country are you in where you can get paid for service rendered, for only 9 days and expect payment of 30 days? This will amount to ***** and secondly in the absents of a valid contract. Please do not threaten me. Should you feel you have a strong case please engage the CCMA.
Firstly, Transport does not work on a 30 day Cycle Brian, It is Monday to Friday! Secondly, There is NO ***** as there is a screenshot of an agreement in place. Which i have sent to Trafalgar many times as well as yourself. Thirdly, I am not threatening you. I am asking for payment which is due to me. Fairview broke the agreement, Not ME! Last but certainly not least. I AM NOT AN EMPLOYEE OF FAIRVIEW GOLF ESTATE OR THE HOA. SO I WILL NOT BE GOING TO CCMA AS YOU CLEARLY STATE I MUST DO I ENTERED INTO AN AGREEMENT - I AM NOT AN EMPLOYEE!
AS MENTIONED IN MY EMAIL TO TRAFALGAR AS WELL AS BRIAN SHOULD I NOT RECEIVE MY FULL PAYMENT I WILL BE TAKING THIS FURTHER.
Please note that Trafalgar is not involved in the Golf Club.

Can you then explain to me Why if you only deal with HOA issues do you then pay the Golf Clubs Golf Course team. Surely this is then part of the Golf Club

I am waiting for a reply from our Cape Town team that works with the HOA - but most of them took leave today.

Today being the 11 August 20220 at 13:17 I am STILL waiting for a response. I am now tired of waiting. Should i not receive full payment of R3000 and a proof of payment by close of business tomorrow the 12th August I will be opening a case at the Small Claims Court in Strand on Monday.

Good Morning, Congratulations on everyone that has been voted in. I would like to ask that this invoice is paid as soon as possible please. I believe I have been patient enough. Please note: My fee was *NOT* charged on a daily or weekly basis. I was charging R3000.00 per month. At no time did I default in transporting Andrew Smalls workers. The Kia that I was instructed to use was taken away. Fairview breached the agreement. I don’t accept the story that there is no contract in place with the HOA.
