Online Shop bait

Online shop that does not fulfill its part of your purchase.

I purchased a watch on the 22nd November 2018 and paid for it confirmation was received and the order was in process, note that Black Friday was on the 23rd November 2018. On Monday the 26th November 2018 i received and email stating that there was a glitch in the shopping matrix. Firstly that is not my fault i paid for a product that showed available at the time of purchase and it still showed stock available throughout the weekend. I rep**** on there email on the 26th November 2018 Cyber Monday with very agreeable solutions to the problem, stock was again available yet my solutions yielded no response instead i received an email to complete a refund.

This is a quick timetable:

° Watch was ordered on 22 November 2018

° Watch was paid on the 23 November 2018

° Email from TFG on the 26 November 2018 at 00:48am stating it had a glitch.

° I rep**** with my obvious frustration but with two agreeable solutions on the 26 November 2018(Cyber Monday) which was ignored.

° The 28 November 2018 at 21:59 pm i received an email to process a refund, i never received a reply from my initial emailing stating that i do not want a refund for a product that was still listed as being available.

I have included the time and date of the screenshots i took displaying stock availability.

To this day there is still stock listed for one of my solutions.

I just want the product i paid for!!!

Simple case:

The Advertising Standards Authority (ASA) has upheld a complaint from a consumer who allegedly to buy a laptop that was advertised for R3 999,00. However the specific laptop was out of stock and would only become available to the consumer a month later.

This was just an example

Reason given by TFG: Oversold My response to your email which was already received previously is again: Consumer Protection Act 68 of 2008: Bait marketing 30. (1) A supplier must not advertise any particular goods or services as being available at a specified price in a manner that may result in consumers being misled or deceived in any respect relating to the actual availability of those goods or services from that supplier, at that advertised price. (2) If a supplier advertises particular goods or services as being available at a specified price, and the adverti*****t expressly states a limitation in respect of the availability of those goods or services from that supplier at that price, the supplier must make those goods or services available at that price, to the extent of the expressed limits. (3) It is a defence to an alleged failure to comply with subsection (1) or (2) if— (a) the supplier offered to supply or procure another person to supply a consumer with the same or equivalent goods or services of the kind advertised within a reasonable time, in a reasonable quantity, and at the advertised price; and (b) the consumer— (i) unreasonably refused that offer; or (ii) accepted the offer, and the supplier has supp**** or procured another person to supply the goods or services so offered and accepted. Your right to protection against bait marketing • Suppliers are not permitted to mislead consumers in respect of pricing, the nature, properties, advantages or uses of goods or services advertised, if such goods or services are not actually available for purchase or procurement in accordance with these standards. • Suppliers are obliged to include limitations in respect of the availability of goods or services when advertising such items, and honour such agreements.
