VEHICLE PURCHASE - False Advertising and non disclosure of faults

<p>on 04/05/2016 Fiat Multipla REG. NN 14678 was purchased from Shaahid AMOD IN NEWCASTLE KZN AT THE TOTAL BBS GARAGE, AT 5 ROOIBOK AVENUE, NEWCASTLE, 2956. THEY ARE OWNERS OF THIS TOTAL GARAGE.</p> <p>THE VEHICLE WAS ADVERTISED IN 'EXCELLENT CONDITION' WITH NO FAULTS, THIS WAS CONFIRMED TELEPHONICALLY BEFORE THE TRANSACTION, AND ALSO ADVERTISED ON THE PRINTED ADVERTISING OF THE VEHICLE.</p> <p>PAYMENT WAS MADE AT NIGHT AND IT WAS NOT POSSIBLE TO INSPECT THE VEHICLE. PAYMENT WAS MADE IN CASH.</p> <p>SHORTLY THEREAFTER, THE FOLLOWING FAULTS WERE DETECTED WITH THE VEHICLE AFTER ATTENDING A TEST CENTRE :</p> <p>VEHICLE SUMP has been damaged/cracked, and a temporary repair with Pratleys metal paste and some poor welding – This is not suitable for passing the requirements for Road worthy examination.<br />Handbrake cable has seized – This is a roadworthy fail.<br />Oil pressure sensor is faulty and needs checking – this is indicated on the electronic dashboard<br />CV is faulty when doing a full turn.<br />Vehicle requires replacement of 4 Shock absorbers – All round, (front and rear)<br />Tappet cover is leaking oil<br />Turbo bearings are worn and leaking<br />Front wheel bearing are noisy and squeaky, showing signs of failure, and require replacement<br />Vehicle has a clutch shudder<br />Gearbox changing handle for selecting gears is loose and comes right off when driving (someone has worked on the gearbox previously)<br />3 Vehicle tyres needed replacement - <br />1st tyre had steel sticking out the wheel<br />2nd tyre had a tube bubble<br />3rd tyre had 3 punctures in it, with the nails still in the tyre from previous repairs.<br />Broken Clutch Rubber on foot pedal<br />Petrol Cap Broken<br />Rear Windscreen Wiper not functional<br />Front Window Washer motor is not working<br />Front windscreen has a minute chip in it.<br />Vehicle has poor battery terminal connections<br />Rear passenger electric window is not working<br />Rear left tail light is missing a large piece<br />Front bottom spot light is cracked/not working<br />Window washer water container is broken/does not hold water<br />Bonnet shocks do not hold up the bonnet when opened.<br />Alternator belt is worn<br />Boot release switch is loose/ damaged<br />Cabin air filter plastic cover is missing<br />Vehicle is missing the ***** that attaches the spare wheel under the chassis.</p> <p>Shortly thereafter, the garage was contacted about returning the vehicle for a FULL REFUND according to the consumers protection act, but I was told that the cash had already been spent.</p> <p>This vehicle is clearly in very poor condition, and not roadworthy, furthermore the costs involved of doing full repairs is between R10,000 - R15,000. These faults were undisclosed by the seller.</p> <p>I have contacted the CEO of Total and am still waiting for a call back regarding this matter.</p> <p><br />I have travelled over 2000 km to collect this vehicle and done minor emergency repairs, ie to emergency handbrake, and tyres etc so that it was possible to travel a short distance safely.</p> <p>I request that my travel expenses, as well as minor repair costs and FULL INITIAL PURCHASE PRICE is refunded to me as soon as possible.</p>
