Unfair disqualify

Good day

Please assist I played a Car competition at Total garage around March April, where you win 2 cars one for me and one for the friend I choose. Today I received a call from a lady by the name Andiswa Gabada, she said I have won this competition I was so happy and she said she will call me back when I have calmed down then she called back from her cell phone number and the network was bad, she then called me from a private number she said she was calling from an office line that when she confirmed everything that I have won a car competition and her I gave all my personal information that she needed and gave out all the details how the handing out will go about and when I should tell my friend that we have won.

The problem started when she asked if I have a driver’s license I said no but I’m in the process of getting one as I have recently started my lessons, she said no I must have the valid driver’s license to claim the price as the Ts & Cs state that. I told her that my partner has a driver’s license and a friend I chose has a driver’s license, she said no she will speak to her superiors and call me back. She even said her superiors will not even consider it as Ts & Cs state you must have driver's license that the car needs to registered under my name no one else. I even suggested my partner can register the car under him and when I get my license it can be handed over to me or they can acknowledge the prize giving and the car can be kept at the dealership garage and when I get my license we can start the process of registering the car under my name. Which all these suggestions failed.

When I got to work, I remembered that the real reason why I played the competition was due to my transport problems for work and that their Ts & Cs don't state I need to have the license should I be a winner as I Knew in the meantime is in process. I went over the Ts & Cs on their website as I wanted to be sure that I read them correct the 1st time. There is nothing about the driver's license and it states I must have a valid SA ID and be over 18years. Yes, I know that I don’t have a valid driver’s license the reason I played is that my partner has a valid, a friend I chose has a driver’s license and I do have a valid SA ID as requested on TS & CS.

Then after a while, I call the lady back to clarify this which she didn’t pick up, I ended up calling the Head Office on ***which I was given reception number *** and I called the number spoke to Andiswa Gabada. I explained to her the Ts & Cs and she asked where am I reading them from, which I explain from the Total website under the competition. She then explained these no way the car will be handed out to me as I do not have a license and they transferred me to her she said the prize has been handed to someone else without informing me 1st and there is no company that can give a car to someone who doesn’t have a driver’s license just like that.

My complaint is or the sad part is I feel that they were not fear as I knew that I don’t have a license but I had a valid ID as stated on their website, I had made an arrangement with my partner with regards to driving the car if I win, a friend that I chose has a driver’s license to drive her car if we won. How can they just give the price to someone else without informing me as she said she will call me back after speaking to her superiors. I don’t see where it was wrong or their reason for disqualifying me as I have done everything that was on their terms and conditions and should the Ts & Cs changed, it is Total responsibility to update their website for the public. I would like to claim my prize as I was promised or take further if necessary. Terms and conditions that were not on the website should not be the reason I don’t get my prize as not even a single line talk about the driver's license. If they are saying no company can give a car to someone who doesn’t have driver’s license how come the competition was even opened to minors with assistance by parents or guardians if they win. And they are companies out there who do give out a car to winners who do not have a driver's license which I work for one of those company.

I have attached the terms and conditions that were on the website on this email. Your assistance will be highly appreciated as I'm so heartbroken I don’t even know what to do. All I know is I want my prize as I was promised and won the competition not because am upset because I deserve to win it and their Ts & Cs says nothing about the license.
