Non-delivery and refusal to give furniture back

I found Dennis Ehrke set up at a small stall in Fourways mall advertising upholstery of furniture. I took a pamphlet and arranged for him to come and pick up two winged back chairs and a seat cover. I picked the fabric and paid my deposit (R2900) and he took away the chairs and seat cover and I was told it would take 3 weeks maximum. This was in July of this year. To this day I have not had my furniture back. He has every excuse under the sun and even put the phone down on my mother and told her she was harassing him when she phoned to demand our furniture back (one of the chairs is hers). When we said we just want our furniture back now and to leave the upholstery - he rep**** that he could not return the items. It is now four months later going on five. At what point does it constitute theft of my furniture and money, or am I just to wait indefinitely. I am also going to enquire at the police station now whether I can legitimately lay a charge of theft as this is just not acceptable - all I want is my furniture and money back.
