The CEO Hlengiwe Luthuli did not appear at the hearing although see was next door at the Royal Hotel, but was represented by a labour law expert Blake Walker. The first thing that I asked of Blake Walker was where are the vital documents that I had demanded be made available to me to prove that I was a registered employee of HLEM. Attorney Walker did not have them. Attorney Walker presented a case to the Commissioner that blatantly deceived him and convinced him that I was not an employee of HLEM which was a very blatant and deliberate lie to negatively influence the outcome of the finding of the CCMA in the favour of HLEM and against me the employee. It was later discovered that both the CEO of HLEM Hlengiwe Luthuli and the accounting officer/HR were both in the Royal Hotel next door and that every time that the attorney Walker went outside the court room to consult with his client by telephone, he in fact was consulting with the CEO and accounting officer/HR in person. Here again the CCMA Commissioner was deliberately deceived by Walker acting for HLEM. The required documents were clearly being withheld purposely to deceive the CCMA Commissioner. As a result of not having the required documents to prove my case, which were still being ********ly withheld from me I was not able to make an appeal during the prescribed period of time.
