The Holiday Club 'no value for money'
<div> When the timeshare points was sold to me, i was not informed that the points will be a 20 year scheme, the sales agent, made no mention of this at all. The value of the points decreases every year( what is meant by this, is that, what i could do in the beginning of purchasing these points, i can no longer do the same. Its as if the points has loss value, cause, every year it cost more and more points to do the same thing), this was also not mentioned to me during the sales process. A club fee is to be paid on a monthly basis of which mine is almost R700 a month, which totals to an estimate of R8400 for the year. These club fees goes up every year as well, which i do understand, but it as risen to a point, whereby i might as well book a holiday privately with my own cash, by not using the holiday club. So i dont see the use of belonging to the holiday club anymore. Also when trying to book a holiday, it is almost impossible to get availability for dates suitable to you as a client and most of popular resorts are usually fully booked, one needs to plan like a year in advance if not more. During the sales process, i was told that i could also one day sell the timeshares, or pass over to my kids, but it was also not mentioned to it be at a far lessor value. I bought my timeshares for over R20 000, now i can only resell it for R4000, of which the process takes 6 months? During this six month waiting to resell, the club fees will already of accumulated to an estimate of R4200. With it only being a 20 year plan for timeshares, how can i pass this over to my kids?! It was was also not mentioned to me during the sales process that i would need to pay a cancellation fee should i wish to cancel the timeshares one day. A few of the points i have mentioned above, i have mentioned over the years before and their resolution was, that i needed to buy more time shares? No! thank you. I do not wish to belong to the holiday club anymore but i tried cancelling my time shares but now and the company is forcing me to pay a cancellation fee, in their response, they saying that the consumer protection act says i must pay a cancellation fee. These timeshares was taken out before the act came into being. Its seems to me as this is also just another way for them to make money. The consumer protection act is quoted in their response to me for needing to pay a cancellation fee and also in the cancellation letter that was sent to me, so in terms of my rights, i do not feel that i had the right to fair and honest dealings, based on the fact that all the information that was not disclosed to me during the sales process as stated above. How would one take this process further as i do not feel, its right based on the dealings that i should pay a cancellation fee. A copy of the Agreement is given to each member when joining The Holiday Club. This is to enable the member to peruse the documents at their own leisure and to ensure that they are happy with their purchase. The Agreement which you signed does state that you have purchased 20 Year Points. Clause A of the Acknowledgement of Presentation document, which states the most important facts of your Agreement and is signed by you point for point, also clearly indicates that your Points which you purchased will be allocated to you annually for a period of 20 years.
We confirm that the amount of Points required to confirm a reservation is fixed and remains the same from year to year. Weeks within the year may be swopped around due to changes in calenders, however, if you add up the Points for a certain unit size at any resort for the whole year, you will see that the Points required for the year remain the same from year to year. The only time that the Points will change is if a particular resort is up- or down-graded. Your statement that the value of your Points has decreased, with reference to reservations, is therefore not correct.
The increase in the Membership and Reservation fees are unavoidable. Increases in water tariffs, annual rates and taxes and maintenance in general, had an adverse effect on the annual increases app**** as far as the Membership and Reservation fees are concerned. We must, however, point out that despite the abovementioned, we have been able to keep the increases, on average, far below the actual
increase in certain items mentioned above.
We work on a live reservation system and all reservations are done on a first come, first serve basis subject to availability.
We will arrange for a consultant to contact you by close of business tomorrow to discuss our reservations process as well as the cancellation process or sale of Points with you further.
