Cancellation fee of R10 000 to terminate membership
I was member of The Holiday Club for 10 years. Since the annual fees increased by more than 10% each year, I decided that the benefit of my membership is not worth it anymore and I dont get any value out of my membership.
When I tried to terminate my membership I was told I need to pay the next years membership as well as a cancellation fee of R10 000.
I offered to pay the next years membership fee if they agree to terminate my membership after 12 months (without a cancellation fee). This they could not agree on.
I understand that perpetual contracts (without an end date), is not allowed by the courts anymore.
Stay away from vacation clubs without an end date. You will have to pay them to get out of the contract.

In terms of the Agreement between yourself and The Holiday Club, you are required to pay an annual Membership and Reservation fee for the duration of your Agreement. These fees are used to cover the levy payments at the Resorts where The Holiday Club holds stock.
However, in terms of the Consumer Protection Act, you have the right to cancel your Agreement prior to the Agreement expiry date, subject to the following:
You are required to give 20 business days’ notice in writing
You are required to pay the outstanding amount due on your account
You are required to pay a reasonable cancellation fee
Should you be unable to pay the cancellation fee in one payment, we can assist you with a payment arrangement over either a 6 month or 12 month period. We will contact by the end of business today to assist with a possible payment arrangement.
