Non delivery of items paid for

I ordered from the website after it said ‘in stock’. I paid for the delivery. Immediately after receiving my payment I get an email saying they don’t have it in stock and it’s still coming from someone neverland. I asked for a refund and then get told that I am bound by the shipping policies and I can’t get my money. This woman is sitting with my money and refuses to refund me even though she doesn’t have it in stock.
