COMPANY PROFITS FIRST !

To whom it may concern, I am Vicky Furstenburg, I rented a car from Tempest Rental Agreement TCTIA ********** RA2.

On Sunday 5 August , 2018 we were traveling on the West Coast towards Langebaan on the R27. Next to the West Coast National Park.

A buck jump from the left side of the road in front of the car, hitting the left side of the car bumper and wheel.

The Bumper was cracked, and it was obvious that the wheel alignment was affected due to the collision.

I immediately informed the call center and was informed that I have the choice of the contract being cancelled and that an amount of R2400 will be deducted from my deposit. OR a new car will be sent the contract continuous my deposit stays intact and the R2400 will be charged to my card.

I agreed to the latter seeing we were in the middle of the West Coast, and being without a vehicle would for obvious reasons be a problem.

About 2 hours later the new car arrived (Thank you very impressed with that service).

The amount of R2400.00 was deducted even before the new car arrived from my account.

No discussion happened after the car was delivered or when I returned the second car assuming the matter was handled and taken care of.

I was astonished when a Invoiced arrived ( ********** 5) for the amount of R9742.27.

The amount for Assessor Free R830.00 + Claim admin fee R672.00 + Damage R6053.00. Total R7555.00.

Needles to say I wat totally chocked and surprised to find I am being held reliable for a wild animal running in front of the car.

With the huge National park situated on the West Coast , and numerous warning signs for wild animals crossing the roads. I am dumbfounded that this is not a standard warning from the rental company. And an obvious problem hence the numerous warning signage.

I also do not understand how a huge company like Tempest do not have cover for “act’s of God”.

Furthermore, I was charged for refueling the vehicle after I filled up the car as the instruction was from the rental office at the airport to fill up at the BP Garage at the airport.

What happened was an act of God no doubt , and for Tempest to make the client pay is VERY UNFAIR.

The vehicle belongs to Tempest , Tempest should make sure they have enough cover for all eventualities. Simply pushing the cost for the client to pay is very dishonest and very convenient way to make sure the company makes huge profits.

I paid for the use of the vehicle and the fuel , if some uncontrollable incident like a wild animal causing damage I should not be held responsible. You are massive big company operating all over , and pushing cost for uncontrollable incidents on to customers is a disgrace.

As a rental company you should know and be aware that YOU take a risk renting out your vehicles and that something/acts of God can and will happen. To simply make the customer pay is appalling. And simple corporate greed.

Hopefully you will have a look at this matter, and rather put your customers experience before company profits first.

I would like to have some clarity regarding a couple of things. First of the vehicle is being claimed to be unroadworthy , yet we traveled to Mykonos with the Vehicle after the incident. On instruction of the call center. The person that brought the new vehicle drove the “UNROADWORTHY” vehicle back to Cape Town. If the damaged was exacerbated due to this we cannot be held responsible for this. I would like to know should the car have been driven? After the incident. According to the report the vehicle was definitely not safe to drive. Yet your driver drove that vehicle back to Cape Town putting other motorist and his own life in danger. And I want a professional opinion on if the damage was made worst due to the car being driven another +- 140 km back to Cape Town Secondly according to your report the car suffered Advanced Structural Damaged, so much so that almost the whole left corner needs replacing YET NO AIRBAGS DEPLOYED. How is this possible? I am suffering from headache’s and a stiff neck. And will be visiting my doctor in the coming week. According to the severity of the accessors report the airbags should have deployed. Was the airbags in working order? Do you have prove of that? https://www.youtube.com/watch?v=anHYfJFKbSE I am starting to think the vehicle given to us is not safe at all, if a small buck caused so much damaged according to your report. What would have been the outcome if that was an antelope, Kudo or a B*****k? Injuries would have been severe, the car probably totally written of AND YOU TEMPEST WOULD STILL MADE ME PAY FOR EVERYTHING AS PER YOUR TERMS AND CONDITIONS. I Will be contacting Ford South Africa , and informing them of how unsafe that car is ACCORDING TO YOUR REPORT. It is totally shocking that a small buck can cause so much damage. And it is totally not acceptable that TEMPEST uses cars that is according to your report definitely not save, if a small animal can causes so much structural damage. How can you allow customers to drive vehicles , that are so unsafe ????????? And you have the nerve to make customers pay for “Acts of God”. You placed my live and that of my passengers in severe danger.

Please be advised that Rental Agreement was signed and accepted by yourself acknowledging that you have read and understood the Terms and Conditions .
