Telesure Holdings/ Virseker 3rd party claim rejected.
On 09 October 2019 I was involved in an accident with Virseker client. The accident involved three vehicle. Virseker client was bumped by another vehicle that didn't stop at a red robot and the Virseker client collided with my motor vehicle. I submitted my third party claim. I was requested to submit document I submitted all the documents requested and my claim was rejected. I was assisted by Gladys Kekana she sent me a letter o the 27 Novenber 2019 stating that my claim was rejected on merits of the collition their client was not the cause of the accident. Gladys Kekana overlooked very important factors that could have assisted her to make a correct decision. According to her it's lawful to drive with an expired drivers licence and also to drive a motor vehicle displayed with an expired licence disc. Virseker client was not suppose to be driving her motor vehicle and her vehicle was not suppose to be on the road. If she was a law abiding citizen that accident could have not happen. In terms of the National Road traffic Act 93 of 1996 it's an offence to drive a motor vehicle displayed with an expired licence disc, as well as driving without a driver's licence or drive with expired drivers licence. Your client was driving with an expired drivers licence, her licence was issued on the 19 July 2014 and expired on the 18 July 2019 and it was her first drivers licence. She only renewed her drivers licence after the accident on the 10 October 2019. The vehicle she was driving was displayed with an expired licence disc which expired on 30/04/2019 I took the photo of the disc at the crime scene on that day. I have evidence. The accident report also state when was the drivers licence issued, Gladys could have counted five years from date of issue. I don't know on what was her decission base on. She had everything that she needed and failed to see that her client was wrong in driving with an expired drivers licence and expired vehicle licence disc. She was only interested on not to pay my claim. I was using that vehicle for business and I have lost three months income. According to your policies it's lawful to drive with an expired licence disc and to drive without a drivers licence. Because you paid your client even though your client contravened the National Road Traffic Act that govern the drivers. No one want to listen to complain and I wanted to forward my complain to your CEO my Mr Tom Creamer and your staff refused to give his email address. My claim was rejected with no valid reason i was told by Gladys Kekana that according to the collition law the person responsible for the accident is liable of the claim. Your client was responsible for the accident as she did not obey the National Road Traffic Act 93 of 1996 Section 18 and Section 42.
