A form (Single page - with heading Telephone Directory) was sent to us numerous times to complete and update our info. No mention of costs or that this is a 12month contract. The form doesn't even state at the top that this is a binding contract and agreement. Only in the last section in the smallest font possible is the so called Agreement. No normal human can read this. After zooming in to the max, this was redible.
Two months later we received an invoice for R10788. No business registration number, no VAT nr and no banking details. Dated 23 October 2020. (First time we rep**** to them was only on 12 November 2020) No decent quote or contract that was received by us or explained and discussed by them.
After sending an email to the customer services email, because the phone number *** and *** is on voicemail. I got a call back from a private number. This is the poorest call centre I have ever dealt with. Threats of legal action against us were made, the lady said that we should pay the R10k or the R5k cancellation fee.
When I asked her if she is fami**** with the credit law, she asked sarcastically if I was a lawyer. I'm not but I know what my rights as a consumer is.
Credit law states that the person handling the agreement (in this case Teledialcom) needs to be sure that the customer fully understands and grasps the said agreement. The agreement must also be easily redible and in a language or dialect that I can understand.
The agreement/contract should clearly state that it is a binding contract, with the parties involved stated clearly. Which is not the case with this piece of paper.
Any agreement/ contract has a 5day cool-down period, which was not allowed because in her words: their (Teledialcom) contracts don't work like that. So does this mean they can change the act as it pleases them? Receiving an invoice on 10/12/2020 that was created 23/10/2020, so how can I enforce my right to this cool-down period.
I will take this further and spread their ********** way of doing business.
