Warranty legally invalid

Home of living brands at Makro attracts customers with 12 months warranty as a standard warranty .i bought airfryer and still under 12 months warranty, they want to to enforce minimum requirement according to section 56 .According to their brochure they are offering 12 months warranty claim.Even their brochure states 12 months as a standard warranty policy, until you have to claim they then refer to section 56 (2) for 6 warranty claim .they hide behind CPA and they impose their own policies which overrides the requirements according to Act 28 of 2008 .Only then I realized that they actually offered an extended warranty plan and it's not disclosed

Good day Gladys,As previously discussed, before any decision can be made regarding a repair or replacement, the unit will need to be returned to our site for evaluation. This will allow us to properly assess the item and determine the cause of the fault. To assist in expediting the process, we have arranged a collection on your behalf, although this service typically falls outside of our standard offering.Once the unit has been evaluated and the fault identified, we will proceed accordingly with either a repair or replacement, in line with our warranty terms. Please note that the product carries a 12-month workmanship warranty. Within this period, the supplier may repair, replace, or refund the product. After the first 6 months, the decision to repair, replace, or refund will be at the discretion of the company.Kindly note that this is not a 12-month replacement warranty, but rather a 12-month workmanship warranty.

Hi

You see my problem with you guys and Makro, you state these processes which are not quoted on your brochure.

Your brochure states as long as the product is within 12 months of warranty can be replaced, refunded or repaired

6 months is a standard warranty requirement according to section 56 of CPA .you are not offering that .you are offering consumers 12 months and it's considered as an extended. Legally invalid.

According to the brochure provided to me when the product was purchased, states warranty of 12 months.you can't offer 12 months warranty and later chang your own policy without admiting error

I have requested a brochure indicating first 6 months replacement warranty. I have emailed your brochure to Makro overrides that standard policy according to Act 28 of 2008

Note I have notified Makro I have lodged a complain with Ombudsman

The item will be dropped of at Makro for replacement or refund. I will not accept a product that is repaired because it's still under 12 months warranty as stated in your brochure

Please send me a brochure that states 22 months is a workmanship and not a replacement and refundable warranty

And also provide proof that the same brochure was made available to me during the time of purchase

Good day Gladys, Please note that the required information will be sent to you via email. You may drop off the product at Makro, alternatively we can arrange collection as a gesture of goodwill, as offered. Kindly note that the unit cannot be replaced or refunded until the assessment has been completed. Once the assessment is finalised, we will advise on the next steps and how we can assist you further.

I already have that brochure and it says a warranty policy if a year is valid

Point number 5 says "I'd the customer relations repair" meaning it is my right to request or deny

You offer customers 12 minths warranty policy and it's ******** because you hide behind CPA

According to the law standard warranty policy is 6 months .your brochure states 12 months which makes it legally invalid.

Therefore your policy overrides the consumer protection act .
