Non return of cell phone

I left my phone in the car on my journey home Saturday morning. Only after doing a sim swap and being able to access my account was I able to call the driver, which confirmed he had my phone and would drop it the next day. I can no longer contact him, have sent through numerous messages to Taxify to assist and have not heard anything back. Is this not considered theft if the items are not returned?
