Threats of Being Sued by Pierre Joubert at Symington De Kok...Very very useless debt collectos who rely on threats instead of resolving disputes
<p>I have a dispute with Vodacom about an unpaid invoice since last year April. I initially had to go through the pain with Barnard, Germond and Associates, till teh matter was handed over to SDK in June this year. During this time being threatened by SMS and my contacts from my cell phone bening called and informed to contact me about my unpaid Vodacom Account. I callled SDK on the same day when i received the email, the June 29th to be specific, advicing about the handing over of the account to them. i called and spoke to a very rude lady, Eunice Seekeo. She was so rude and i informed her that i wanted to speak to her superiors. I spoke to an Angela Schoeman (Vodacom Book Manager), who understood what i was saying about the dispute and promised to look into the matter and personally deal with this issue and apologised for the experience. She emailed the specifics on the 01 July where i responded to her on the 02 with my specific issues and concerns. She disnt respond to me even after my reminder to het on the 07 July. During the course of the day, i was informed by my wife that her father had received a call from someone at Symington de kok(SDK) inquiring about me. this is now more than a week after i contacted them having received their email and correspsonding with Ms Schoeman, having given her all the relevamt contact numbers, even reminding them that the number in dispute has been active since it was ported in april 2015. She then apologied and again stated that she will handle the file. On the 8th Ms Schoeman advised that she was awaiting response from Vodacom. on the 12 July, a response was forwarded by Ms Schoeman from a Criton Muridili, vodacom's collections legal administrator. Not even answering my point or looking at what i had to say, the email stated that SDK to continue with the collection. I responded to both Ms Schoeman and Criton. </p> <p> </p> <p>Not receiving a response from my reply of the email of the 12 July from Vodacom, my reply being on the same day, i went to vodaworld on the 29th August. The very kind lady, Sharon Zitha at the customer care centre, tried internally with vodacom legal department to get the matter resolved, but i was received with Hostility by Vuyo Jack or Jacks, her number being ********** 030. She indicated that she will not escalate my issue and that my matter was going to be dealt with by SDK. She then dropped the phone on me. Ms Zitha, bless her underpaid and overwored soul tried to get hold of Ms Schoeman. She was informed that Ms Schoeman was busy and the call was taken by a Katlego. this lady was so rude, not even allowing me to have a word edge wise. Not even knowing the specifics of my case she indicated that i would not be in such problems if i paid my accounts. She then dropped the phone on me when i was showing her the error of her ways with the fact that she didnt even know my specific case.</p> <p> </p> <p>I then emailed and called Ms Schoeman on teh 30th, documenting the problem i had with Katlego. I happened to be answered by Katlego when i was looking for Ms Schoeman, with her indicating that she reports to Angela. When Ms Schoeman eventually returned my call i expressed my dissatisfaction of being treated like a common ******** by her staff. She promised to listen to the recording and revert back to me. On the 31 August, i reminded her about our telephone conversation and that she was to revert to me in writing after having listened to the telephone call and aslo to indicate what steps to be taken to address the employees unwarranted and unprofessional conduct. I also wanted information from her where they had received my father in laws details. She then chose to respond to the vodacom issue and left issues related to her company. I emailed her, reminding her that she has ommitted responding to the specific issues raised with regards to her company. She chose to Resond as follow: " Kindly be advised that the actions of our employee Kathlego has been referred to our relevant department." I then responded as follows:</p> <p>"Running the risk of sounding like a broken record i will repeat. As per our telephonic conversation and my email to you this morning, i still await a report from you regarding your initial investigation of the telephone call between myself and Kathlego. I was advised by you that all your calls are recorded and that you will revert back to me in writing. All you now are saying is that it has forwarded to the relevant department. You will appreciate my ignorance at your structure and systems and therefore understand that when you refer to the "relevant department", please appreciate that a more detailed explanation regarding resolution of my complaint should be clearly stipulated with relevant time frames. (i find it very interesting that Kathlego says that you are her immediate boss, but now the responsibility is being shifted to an unnamed "relevant department")</p> <p>Furthermore, you still have either chosen to ignore, not willing or able to respond to my questions about contact details of my father in law. I would therefore request you escalate the issue to the appropriate person/s so as to get a response to that particular point.</p> <p>As i indicated, i want a finality to this issue ASAP and would kindly appreciate that i get the details as requested with time frames. Again, should you be unable or unwilling to respond, please escalate up your organisation to the person who is responsible and has to respond to me." I include this specific email beacuse from this point i have been put on silent as follow up emails on the 7th and 20th September have gone un answered. On the 21st i received the following email from Miguel Francisco ( who has been copied into emails by Ms Schoeman from the 31 August, i have also included him from this date), "Please advise what it is that you are requesting from our office’s ?" I responded by refering him back to all the correspondence he had been copied in on and asked himto go and check specifically referring him to the email of the 20th September. On the 26th September, i reminded Miguel that i was still awaiting his response.</p> <p> </p> <p>Noting the silent treatment again, i escalated to the Managing Partner, Christie Beukes at 09:09 this morning. I emailed him summarising the events that got me to him and forwarded him the emails. He responded and inicated that my matter was noted and that i would be addressed shortly, Ms Schoeman, miguel and Mr Pierre Joubert were copied in the email at 09:17. I then received an email from Miguel at 09:25 requesting to know what number my father in law was called on and whrn he was contacted. At 13:28 I reminded him that i had escalated the issue because he was ingorning me and requested that Mr Beukes deal with the matter. He responded indicating that the matter was escalated to him. I reminded him that it was de-escalated as he failed to respond to my emails initially. I requested that he gets the file from Ms Schoeman who was copied in Mr Beukes original email. i did give him my father in law's number and date of contact at the end of the email which was sent at 14:34.</p> <p> </p> <p>At 16:26 i receive a call from a number identified to be spam by true caller, ********** 600 Theuns... A Mr Pierre Joubert was on the line from SDK. He indicated that he was follwoing up on my matter as was sent to him by Mr Beukes. He wanted to know the details of my complaint and i referred him to the communication i sent to his colleagues as well as the Managing Partner. We had a backwards and forwards session as he kept on interupting me and i reminded him that we would not get anywhere if he interrupted me. In essence i repeated my cncerns with him. He responded by indicating that they had handled the issue of Katlego internally and that i as a third party did not have a right to their internal processes. i reminded him that he was incorrect in his ascertions but would not allow me to speak. i reminded him that i had complained and was awaiting the report of the recording. That they had follwoed a process internally that i did not have insight to was absurd. He then changed the subject and asked me when will i be paying. i reminded him that we had not concluded why i had compained. He interrupted me and raised his voice. I rasied my voice as well. When he seemed to be calming down i allowed him to speak. He indicate that he had listened to the call and that i had called her a *****. i requested the recording as i was disputing what he was saying. we then had a shouting match then he dropped the phone on me. The call lasted 8 minutes.</p> <p> </p> <p>I called the SDK office and asked to speak to Mr Beukes. I was transferred to his secretary. She tried putting me through but the line was not picked. She then took my details and sent Mr Beukes a message there and then. i confirmed with her that Mr Beukes was indeed the Managing Partner to which she responded in the affirmative. This call was made by me at 16:36.</p> <p> </p> <p>At 16h48 i received a call from ********** 607, and it was Pierre Joubert on the line. I reminded him that i had called the Managing Partner and not him as he decided to drop the phone on me. he called me unprofessional and told me that he was a senior partner and that he was equal to Mr Beukes. he indicated that all matters debt collecting would be referred to him. I told him that i had no interest in talikng to him as he had shown his colours in our earlier converasation. i then dropped the call on him. He called again at 16;49 with the 087 spam number as he had called with at 16:26. I answered and heard it was him. i reminded him that i did not want to speak to him. he had dropped the call on me and i had returned the favour but at no point were we equal. he laughed and told me that he was going to sue me. He said that i will have my day in court, he will sue me and that i must defend myself. i dropped the call at that point.</p> <p> </p> <p>In this day and age with all teh law, you would assume laywers would have sense and be sensable about matters. I see two missed calls on my phone at 16:51 and 16:54 from ********** 607, likely Mr Senior Equal Parnter, Pierre Joubert.</p> <p> </p> <p>Please bring it on... as i stated over the phone and im saying again... Bring it on!</p> <p> </p> <p> </p>
