******** Blacklisting

On 12 October 2020, I registered my daughter with Swimmattix and duly paid the registration fee of R100. We thereafter received notification that her lessons would commence on 19 October 2020. As my daughter is very anxious, my husband, called Swimmattix on 14 October 2020 to request a free trial lesson before committing to ongoing lessons commencing 19 October 2021, and this trial lesson was agreed to telephonically.

My daughter attended the trial lesson on 14 October which she did not enjoy. It was evident from that lesson that she did not want to continue swimming instruction with Swimmattix. There were no administration staff around on that particular day, and the only instructor present was at the pool. As a result, we could not discuss the matter with anyone. I therefore emailed Swimmattix on 15 October 2020 wherein I advised that, as my daughter did not enjoy the trial lesson, she would not be continuing with any further lessons.

I thereafter received an email from a person who works there who advised that we had enrolled our daughter in the class and would have to swim out two months. This is factually incorrect as any further lessons were subject to Gabriella enjoying the free trial lesson, which she did not. I responded to the person on 16 October wherein I made it clear that my daughter's enrolment had been made subject to the free trial lesson and that, as she did not enjoy it, we would not be taking up the registration and no further fees would be owing.

Subsequently, there have been numerous phone calls and emails between your finance administrator and myself, wherein we have tried to resolve this matter, although all attempts have been unsuccessful despite clear evidence that we terminated our daughter’s registration a number of days before 19 October 2020 which was in line with our rights.

I have recently app**** for an extension on my home loan whereafter I discovered that I have been blacklisted by Swimmattix for non-payment of my daughter’s so-called ‘swimming fees’. This was done despite my many attempts to explain to Swimmattix that my daughter's registration was cancelled in advance and without her having received any lessons (over and above the free trial lesson). You have ignored all attempts made on my behalf to resolve this situation and taken the highly ********* and ******** step of blacklisting an innocent consumer.
