Deposit *****

Moved out of house 30 March 2019. Did checklist for faults with 2 estate agents present and both agreed that house was clean and in good condition except for small part of the wall where the couch removed some paint and left a mark. Was told that it's not a big problem to fix and that rental deposit would be paid back shortly. Waited for almost a month and only part of deposit was paid back because wall hasn't been painted/fixed yet. Now almost 2 months later no feedback on wall or costs for paint and labour to fix the part of the wall that was damaged. They don't answer their phones, and when they do, always a heap of excuses, it's always tomorrow or the next day. I want to know where the rest of my deposit disappeared to and if or when I'm going to get refunded with the rest of what I'm owed.

The tenants in this case failed to pay rent for both February and March 2019 and, in terms of the lease agreement as well as the Rental Housing Act, the agency was within its legal rights to use the double deposit for the 2 months' outstanding rent. However, we felt sorry for their circumstances and only used 1 month's deposit to cover some of the outstanding rent. On 9 April 2019 we refunded them with R5000 of the remaining deposit of R7500 in order to help them financially. Seeing there was a new tenant in the unit, we struggled to get access to finalize the maintenance & repairs on the damage which occurred in the period of Mrs Potgieter as tenant and could only finalize that during May 2019. The balance of the deposit after repairs was paid to them on 20 May 2019! The allegations of deposit ***** were false as can be seen from my explanation and the tenants in fact received a full R7500 more back than which they were supposed to do...
