Irrational Settlement

<p>On my 40th birthday, a huge storm resulted in a Lightning Strike which annihilated a palm tree in my front yard, and took out my entire electronic gate system. </p> <p> </p> <p>After an initial inspection, their contractor came back to replace the PC board from the gate motor, before they determined that the damages extended to at least one of the gate motors too. </p> <p> </p> <p>When I next queried the status of my claim, they said they would be providing a settlement, yet when I queried the amount of the settlement they refused, and continue to refuse, to accept that what they're 'settling' covers less than half of the actual damages incurred.</p> <p> </p> <p>They claim that covering the full amount for the full system, including both motors (which are a paired set) would be construed as 'betterment'. </p> <p> </p> <p>How in their right minds can a replacement electronic gate system be betterment, when it wouldn't open any faster, any quieter, any more efficient than my old system. </p> <p> </p> <p>How can they claim that, since only 1 of the motors in the paired set of motors was blown, only 1 motor would be covered under the claim when the entire system became end-of-life several years back and replacement parts of any part of the system are no longer obtainable?</p> <p> </p> <p>On top of all that, they refuse to return my calls and refuse to budge on their stance, yet 6 weeks after my 40th birthday, I'm still without a functioning electronic gate, putting myself and my entire family at risk.</p> <p> </p> <p>Lastly, they have not even offered a response or plan regarding the now dead palm tree in my front yard, which in itself will pose a huge risk to the life of anyone on my property by next summer when the tree begins to decay.</p>
