Estate left hanging
I have been waiting for 7 months now to get executor appointed to wrap up my mom’s estate. Excuse is always the High Master office delays. I have been dealing with Attie Smit who has continually been very abrupt and rude to me when I call to enquire, in competent comes to mind!
Service is absolutely atrocious and they couldn’t care about their customers.
Where to now? Where do we report them to?

08 Jul 2022, 17:48The telephonic conversation of 5 July 2022, between yourself and our Mr. Smit refers.
On the review of our file, we wish to advise as follows:
- That although the estate has been registered on the Master of the High Court Johannesburg system (portal), we have not received the Letters of Executorship as yet;
- That the matter has been pursued at the Masters’ Office (as is the case with all the estates we are dealing with), in person with Mr. Rufus Mulaudzi, in writing see attached letter dated 28/06/2022 as well as telephonically;
- At the meeting between yourself and our Mr. Smit on 14 December 2021, we have made it very clear, that we can not act as the Executor in the estate without the Letters of Executorship, and furthermore that you will be notified on receipt of the Letters of Executorship as well as when the estate will be advertised in terms of Section 29;
- At the abovementioned meeting we also notified you of the difficulties and challenges we currently experience at the Masters’ Offices;and
- Please note that we experience the same problems with at least a third of the estates reported at the Master’s Office, therefore this particular one is no exception.
Attached hereto please find a copy of a recent letter dated 28 June 2022 from our office address to yourself, confirming the fact that we still await the Masters’ appointment.
In the light of the above, it should be clear that STABILITAS Board of Executors (PTY) Ltd, has not only done what has been discussed at our mentioned meeting, but is constantly following up on this matter to get the problem resolved. However we will not apologized for matters which we are not responsible for neither have control off such as the Masters’ Office. Your accusation that no one from this office reported on this matter to you, proof to be false as the attached letter proofs.
With regards to your remarks on your social media posting, you failed to mention the fact that Mr. Smit said that he can not comment on the particular matter at the time, for the simple reason that he is not available to deal with the matter on a daily basis, and thus as promised, to give feedback today once the file has been reviewed.
