Spar Barclay Negligence
At around 5pm on the 20th of November 2024, I went to do a few groceries at Spar Barclay Square in Sunnyside, Pretoria. As I was doing my shopping, trying to get some spices, a cupboard door fell on my ankle, hurt me and left me scarred and limping. Why would they have a door that's not properly inserted, why would they put their customers lives in danger like that? Now I would call that negligence.
A security guy came to check if I am OK, as it was visible to everyone that I am injured, he then went to call the manager, a number of stuff members came to check on me. I was then taken to a Medical center, which happened to be at the same complex as Spar and was attended by Doctor N.T. Moukangwe, I was accompanied by 2 Spar superiors a Lady and Mr Raymond Malaka. Dr Moukangwe gave me an injection and my feet got bandaged and wrote me a 3 days sick note, with very strict rules not to use my left leg as that might make worsen my injury and Mr Raymond Malaka was also given the copy of my sicknote. I then asked what's going to happen to my business in these 3 days because I am a self-employed fashion designer and have Fitting appointments scheduled in the next 2 days, the Dr made a suggestion that I should find an assistant for the next 3 days and Spar has to pay the assistant as I will not be able to do my work myself. That seemed to not to be a problem to Mr Raymond Malaka and he promised to speak to his superior about that and would give me a feedback ASAP. Mr Raymond Malaka even took an image of my ankle at the doctors room. He indeed gave me a call at around 19:05 to tell me that his Superior (Manager) says they won't be compensating me in terms of paying for the assistant that's supposed to come help do my work, they made it clear, that, if I feel like, I should go ahead and SUE them and they don't care and that they won't be taking me to the hospital for an X-Ray (21 November 2024) as suggested by the doctor. Now what kind of a treatment is that? How can one be injured at your store and you don't take responsibility, I was not even thinking about suing Spar, all I wanted was for my the assistant to get paid so that I can fulfill my appointments as scheduled.
