South Point student accommodation
I was a tenant at South Point Kincora building in Pretoria. I have a query with regards to the obligations of the landlord which were not fulfilled during my stay at South Point.
The Rental Housing Amendment Act 35 of 2014 section 4B(1)(b) states that a landlord may require a tenant before moving into the dwelling to pay a deposit which must be invested by the landlord in an interest bearing account in a financial institution. Provided that the rate on the account may not be less than the rate applicable to a savings account with that financial institution.
I initially paid a deposit of R4000 however on the November statement, it was stated that I'd only be getting back R3200 because they subtracted the shuttle service payment from the deposit which is R800. From my understanding, I'm supposed to be receiving more than R3200 because my deposit was supposed to be invested in an interest bearing account with a financial institution, however this was not the case.
I spoke to a lady by the name of Simangele from South Point who said and I quote "South Point is a private accomodation and is not regulated by that Act" which is strange because it is ******* to run a company which goes against the provisions of the law of the country
