On the 1st Feb 2022 I bidded for a car which was advertised on their website. I won the bid, paid dues and traveled from Mthatha (EC) to Boksburg (Gauteng) to collect the car on the 7th February. On my arrival the car was not in the condition as was advertised on the website. The engine is broken and the conrod on the piston is kept inside the car. The car was a "non-starter", contrary to what was said on the advert. Of course they state it on their Ts&Cs that the condition of the vehicle may change as they only assess vehicle on its arrival. I then canceled the purchase and discontinued the deal.
The branch manager at Boksburg (Siyabulela Njomane) saw the problem and sent an Email to Jason Le Roux and Nqabakazi Nabe notifying them of the issue. Nqabakazi Nabe rep**** approving cancellation, However with a penalty. The penalty is an amount of R5000 which is the deposit I paid in order to bid.
My dissatisfaction is that they didn't tell the truth about the condition of the vehicle. They marked it as a "Starter"although even on the 'start odo" there was no indication of a running engine. Having noticed that there was no fuel I made assumption that there car was a starter just ran out of petrol. It didn't appear as a starter. It came as a shock that the engine was damaged and the advert was misinformation.
It is completely ********* for an auctioneer to present false information on the item on auction.

There is a sale cancellation on your account for a sale that took place in Sandton for an amount of R66 415,00. You came to collect the vehicle and was not happy with the states of the vehicle, the sale was cancelled on merit as you were a first time buyer. This sale cancellation was approved by both Nqabakazi Nabe and Jason Leroux.
You were advised by Nqabakazi Nabe who physically attend to you at the SMD Sandton branch on the 31st of January to view the salvage vehicles physically. if you are not able to view, you can request more images from the branch on your next purchased before placing your bid. You bided on the vehicle in Boksburg and accepted the terms and condition of the sale. Once you place your bid, you have accept that you have acquainted yourself with the condition of the vehicle prior the sale.
1. All vehicles are sold as is. 2. The buyer agrees that he/she has acquainted themselves with the condition of the vehicle(s) prior to sale and understands these vehicle(s) may need repair in order to be in a safe working condition. 4. The buyer acknowledges that neither the seller of the vehicle(s), nor any SMD representative gave any warranties or guarantees, or made any representations with regard to the condition or state of any vehicle sold. 5. All vehicle descriptions given by SMD are a close representation only. SMD will not be held liable for errors in description, and no refunds or returns for same will be entertained. The responsibility to verify the exact derivative of each vehicle lies with the buyer. Mileages displayed on the vehicles are not guaranteed. 6. Additional costs for the buyer's expense and discretion will include: (1) Repairs and sourcing of repairs of vehicle(s), (2) Keys, if none at time of sale (3) Removal of vehicles from premises (4) Licensing (5) Police Clearance Fees where applicable.
