Falsified mileage

Bought a car online with mileage of 25000kms. Wine the auction and verified the chassis number with Mercedes who confirmed a service at 85000kms. The car had a falsified mileage and SMDs solution was to charge me a penalty for not buying the car.

Please note SMD gives you the option to view the vehicle before placing your bid or making full payment on the vehicle. If you are not able to view, you can request more images from the branch.

Once you bid on the vehicle you have accept that you have acquainted yourself with the condition of the vehicle prior the sale.

Please find below point stated in our Terms and condition. (Point 4) https://www.smd.co.za/terms-and-conditions 
  1. All vehicles are sold as "Motor Salvage", irrespective of their appearance or condition.
  2. The buyer agrees that he/she has acquainted themselves with the condition of the vehicle(s) prior to sale and understands these vehicle(s) may need repair in order to be in a safe working condition.
  3. The buyer acknowledges that neither the seller of the vehicle(s), nor any SMD representative gave any warranties or guarantees, or made any representations with regard to the condition or state of any vehicle sold.
  4. All vehicle descriptions given by SMD are a close representation only. SMD will not be held liable for errors in description, and no refunds or returns for same will be entertained. The responsibility to verify the exact derivative of each vehicle lies with the buyer. Mileages displayed on the vehicles are not guaranteed.

Please accept responsibility for false advertising!
Furthermore, SMD does not release the chassis number until invoice.

Let the above response be a warning to future users of the online auction site

Please note your are allowed to call the call center or the branch and request for the vin/Chassis number.

Cool, so we shouldn’t trust anything you advertise? You have not acknowledged that your car is shady! Tampering with mileage is *******. You might as well be selling a ****** car.
