“A Small Business Ignored by Two Major Corporations”
More than five years ago, we completed a repair for Avis/SMADA. The repair was done to the highest standard, the vehicle is in immaculate condition and we have safely stored it on our premises for the past 5 years. Despite this, we have still not been paid the outstanding repair balance or the storage costs. More than 2½ years ago, SMADA issued and signed a formal written agreement confirming that they would provide the vehicle licence papers so that the remaining balance could be offset. This agreement was signed by both parties, yet it has never been honoured. Even with a legally binding document in place, our repeated requests have been ignored. Over the years, we have received conflicting information about who is responsible: Daniel and Haneef at SMADA kept giving us the run-around, making empty promises and informed us that the licence papers were being withheld. Only after this back-and-forth did we discover that the vehicle actually belonged to Avis on rental, Daniel from SMADA informed us of this via email. This constant confusion has caused immense frustration and wasted years of our time, energy and resources. Recently, i have been passed around again, this time to Mr. P. Naidoo, and I have been trying to resolve this with him for the past four weeks. 4 weeks back he promised to release the licence papers and even sent a WhatsApp message saying he had a meeting with legal to instruct them to release them. In all fairness Mr Naidoo has had only had 3 to 4 weeks to deal with the matter, so he cannot be held accountable for the past 5 years delays. After years of waiting, pleading and trying to follow every procedure, this continued delay feels crushing and incredibly disheartening and yet we continue to be met with empty promises and silence. I have done everything in my power to resolve this matter professionally: • Emailed Avis Director Denise Ngwetsheni twice — ignored • Emailed 6 different people at SMADA including management. • Emailed Avis Customer Service — ignored • Emailed Avis Complaints Department — ignored • Sent over 25 emails in total • Made more than 200 phone calls • Escalated to multiple staff members, managers and directors Despite all this, nothing has been done. We are a small business with only 17 employees, while Avis has thousands of staff worldwide and SMADA has thousands. Both companies even secure government contracts. For two corporations of this size and influence to ignore a small business, refuse to honour signed agreements, withhold payment and cause financial strain is unacceptable, heartbreaking and deeply unfair. We are a small business and we simply cannot afford to hire an attorney to fight a case that should have been resolved years ago. How is it fair that two massive corporation, with thousands of staff and even government contracts can place a small, hardworking business in this position, ignoring our agreements, withholding what is owed? This treatment is crushing, disheartening and deeply unfair to a small business that has acted in complete good faith. We acted in complete good faith, repaired the vehicle to a high standard, stored it safely for years and followed every promise made by these companies. How can two major corporations treat a small business led by a 64-year-old woman this way? I urgently request that Avis and SMADA settle the outstanding repair balance and storage costs, so that this long-overdue matter can finally be resolved.
