Took deposit and cant deliver goods

Eugene from Skye creations, cell no +27 (72) ***, took a deposit of R400” to build n bed headboard and side tables, after numerous calls from my som Jaques and many whats apps, Eugene confirmed that he will refund the money as he cannot deliver the goods and then promised to refund the money that he never did, he then turned off his cell and doesn't return any e mails, we contacted our attorney and he also cant get hold of anyone at Skye creations, Eugene has taken the money and are still operating, we find this totally unacceptable and he deceived us.
