I've been ****med by Simunye Debt Advisory.
I was contacted by Simunye Debt Advisory to apply for debt review. I expressed interest but informed them I could only proceed in two months. During the initial consultation, the consultant, Mr. Morgan took my details, and I disclosed that I was married but separated. I also explained that my ex, with whom I have minimal contact, would not consent and was not in South Africa at the time. At a later stage, I informed Mr. Morgan I was ready to proceed. We completed my application, and I submitted all required documents. He later questioned my marital status, claiming I had not disclosed it. I clarified that I had informed him during our initial conversation and provided proof via WhatsApp messages. I also requested voice logs of our earlier discussions to confirm this. Despite this, they debited my account, placed me under debt review, and later cancelled it due to my marital status. When I requested a refund, they refused, stating the fees were used for legal work. They then claimed voice logs were unavailable, WhatsApp messages were deleted, and Mr. Morgan had left the company. I repeatedly followed up, questioning why checks were not done earlier and why the signed document stated "Separated" if they were unaware of my marital status. They provided no clear answers, instead blaming me for not being transparent. This is incorrect, as I provided all necessary information upfront.
Upon the initial assessment, Mr. Morgan failed to inform me that I did not meet the criteria for debt review. Had this been communicated to me at the outset, I would not have re-engaged with him subsequently. Furthermore, during our interactions, I explicitly informed Mr. Morgan that I was not ready to proceed with debt review at that time. It was his responsibility to advise me that spousal consent was a prerequisite for the process and to inform me that the application could not proceed without it. Instead, despite being aware that I could not secure spousal consent, he continued to process my application when I later indicated my readiness to proceed.
It is deeply concerning that the voice logs and WhatsApp communications reflecting these interactions are now reportedly unavailable. This absence raises significant questions about the integrity of their record-keeping practices and opens broader concerns about their business operations. These records are crucial as they directly contradict the explanations they have provided.
This inconsistency demonstrates a failure to adhere to standard practices. This deviation from due process is both ********* and misleading. Charging restructuring fees and retaining funds for work undertaken without fulfilling fundamental requirements is unacceptable. Simunye’s inability to produce call records calls into question the credibility of their claims as these records are critical to resolving this matter. To make matters worse, they are still retaining me under debt review. Not only have they infringed on my right to access recorded phone calls, but they have also infringed on my right to be removed from debt review.
Their actions thus far have demonstrated a lack of ethical business practices and accountability. I have since sought full redress through the appropriate legal avenues due to their failure to resolve this matter. Their responses thus far have failed to address the core issues, nor have they provided a satisfactory resolution.
