Shesha unfairly cancelling online orders
In September 2022, I purchased 5 pairs of Nike Dunk Lows from Shesha's online website.
I was contacted by a staff member informing me that I could only have one pair, as it is one pair per customer. I was also told that all my other pairs I have ordered would be cancelled.
However, on the website, where I purchased the pairs, there was no description indicating that the shoe is limited to one pair per customer. Additionally, there was no functionality enabled preventing me from checking out more than one pair. The indication that it is limited to one pair per customer was only detailed on social media and I do not have a personal Instagram account.
I believe that cancelling the 4 other pairs is potentially in contravention of the Consumer Protection Act. I have detailed the applicable sections below:
S24 Product labelling and trade descriptions (1) For the purposes of this section, a trade description is app**** to goods if it is— (a) app**** to the goods, or to any covering, label or reel in or on which the goods are packaged, or attached to the goods; (b) displayed together with, or in proximity to, the goods in a manner that is likely to lead to the belief that the goods are designated or described by that description; or (c) is contained in any sign, adverti*****t, catalogue, brochure, circular, wine list, invoice, business letter, business paper or other commercial communication on the basis of which a consumer may request or order the goods.
The basis of which I could order the goods (namely, the shesha website) as indicated in (1)(c) above, did not indicate that it was limited to one pair per customer.
(2) A person must not— (a) knowingly apply to any goods a trade description that is likely to mislead the consumer as to any matter imp**** or expressed in that trade description;
The one pair per customer rule was only present on social media, however it needed to be present on the basis of which goods could be ordered (the website). All other retailers adhere to this requirement, and in this regard, I believe that Shesha did not.
In line with the above, I believe that my order should be completed and that I may receive the 5 pairs of dunks which I have paid for and therefore reserved.
I have reached out to the Shesha sales team, namely through the following email addresses: ***, *** with no response from any emails or follow-ups.
I would like a response regarding why Shesha thinks they have comp**** with the Act sections above, and if they also believe that they have not comp**** then I would like some incentive for my troubles and poor customer experience.
