Damaged cell phone received and deemed out of warranty by repair ctre

The consultant that sold me the Hisense U962 cell phone contract did a great job. I do not commit to telephonic deals as one is always advised of the poor communication received afterward. The phone was received damaged, sent back and Telkom advised that the phone is deemed out of warranty and that there is a cost involved in fixing it. Then I receive a telephonic call from consultant, Ethne Botha to advise that the cost is for my account as it was physical damage and If I do not pay for the repairs, I am liable for the contract. What kind of business is Sell Direct Marketing running???
