Seef Southern Suburbs Cape Town - what a joke!

I am still waiting for Seef Southern suburbs (Woodstock) to refund my deposit for more than year. Incredulously I am the landlord. Seef failed to complete exit inspection and tenant fled with my keys failing to pay at least 4 months rent. He left the apartment hastily with drugs lying about, filthy condition as well as a long list of missing items. More than a year later he fails to respond to messages or e-mails. The agent, Mrs Khonker does not deny any of these claims above as Seef is fully apprised of the details and know for a fact as they conducted an inspection in absence of tenant. She advises that Seef refuses to make payment to me (despite not being able to get hold of tenant for more than a year and despite an agreement on my part to sign an undertaking that extinguishes any future liability they may have in this matter by making such a payment to me) due to the fact that the tenant must give permission to release the deposit to me!!!!!Where is the logic? Where is the justice? There is no piece of legislation that entitles Seef to hold this payment but they continue to do so. I have laid a complaint at the EAAB and not entirely sure why they think this is correct in law or otherwise? The deposit is not even sufficient for the loss of 4 months rent and the damages.
